⚠️Urgent! Today (5 Sept.), the Criminal Court read out the Court of Appeal’s judgment in the #Section110 case on the charge of “committing an act of violence against the Queen’s liberty.” The Court of Appeal reversed the trial judgment and imposed prison terms: Ekachai Hongkangwan 21 years and 4 months; “Francis” Bunkueanun Paothong, “Tun” Suranat Paenprasert, and two other citizens 16 years each, no suspended sentences.

The case stems from allegations that they collectively obstructed the motorcade of Queen Suthida, accompanied by Prince Dipangkorn Rasmijoti, during the #14OctProtest in 2020.

The Court of Appeal found it credible that all five defendants knew it was the Queen’s motorcade and that all five engaged in conduct obstructing it. The offense was completed but did not achieve its aim, so it constitutes an attempt, as the motorcade ultimately passed through. The protest involved more than 10 people, with Defendants 1–3 directing the obstruction of traffic.

Whereas the trial court had acquitted the defendants, the Court of Appeal disagreed and upheld the prosecutor’s appeal.

The Court of Appeal therefore convicted all five under Section 110, Section 215, and obstruction of traffic. For the traffic obstruction count, the penalty is a fine.

Because their conduct was a single act violating multiple provisions, the court imposed the heaviest penalty under #Section110: 16 years’ imprisonment each, with an enhanced sentence for Defendant 1 (Ekachai) totaling 21 years and 4 months, without suspension.

Applications for bail pending appeal to the Supreme Court are now being filed for all five.

In 2023 the Criminal Court acquitted them on all counts, finding that police had not announced to protesters that a royal motorcade was approaching and that there was no evidence the route was a regular royal route. Protesters therefore could not have known a motorcade would pass until riot police formed a line and began to surround the royal vehicle, leading protesters to believe the police were trying to disperse the demonstration. Protesters then responded by raising the three-finger salute and shouting. The incident arose from a mutual misunderstanding by all sides.
