Legal Consequences Under BNSS, 2023 Following the #Dismissal of an #FIRQuash #Petition
When a petition seeking to quash an FIR registered in a criminal case is filed before the High Court under Section 528 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, and the High Court dismisses the petition upon finding that a prima facie case exists, the investigating agencies are legally entitled to continue the investigation by exercising their full statutory powers.
Under Section 173 of the BNSS, if information relating to a cognizable offence has been received and an FIR has been registered, such FIR continues to remain valid and legally enforceable.
Under Section 176 of the BNSS, the police are vested with the authority to investigate cognizable offences. Therefore, upon dismissal of the Quash Petition, the Investigating Officer may proceed with all investigative measures, including examining witnesses, collecting documents, gathering evidence, and undertaking all other lawful steps necessary for the investigation.
Under Sections 35 and 36 of the BNSS, the police have the authority to arrest the accused person, provided the statutory requirements and conditions prescribed by law are satisfied and such arrest is necessary for the purposes of investigation. An arrest is not a punishment; it is a legal procedure undertaken in the course of investigation.
Under Section 187 of the BNSS, a person who has been arrested may be produced before the competent Magistrate, and appropriate orders relating to police custody or judicial custody may be sought in accordance with law.
Under Section 193 of the BNSS, upon completion of the investigation, a Final Report or Charge Sheet may be filed based on the evidence collected during the course of investigation.
Further, when the High Court dismisses a Quash Petition after recording that a prima facie case exists, such judicial observation strengthens the legal basis for continuation of the investigation. Consequently, the investigating agencies may proceed with the investigation without delay and take all necessary legal steps within the prescribed time.
However, the mere dismissal of a Quash Petition does not render the accused person guilty of the offence. Until guilt is established through due process of law, the accused continues to enjoy the presumption of innocence. Nevertheless, the dismissal of the Quash Petition removes any impediment to the lawful continuation of the FIR and investigation, which is a fundamental legal consequence under the BNSS, 2023.
