Shanda Vander Ark was convicted of the brutal torture & killing of her teenage son Timothy Ferguson. Timothy’s older brother, Paul Ferguson, was also involved in the abuse of Timothy.
Despite Vander Ark’s argument that her attorney failed to represent her properly at trial - she has been DENIED a new trial.
According to the eight-page ruling, Circuit Judge Matthew Kacel said;
“The evidence of (Vander Ark’s) guilt in this case was overwhelming. Assuming (Vander Ark’s trial attorney) was deficient, the court cannot find that there is reasonable probability the correction of those errors would have resulted in a different outcome.”

Shanda Vander Ark took the stand in her quest for seeking a new trial!
She was convicted of first-degree murder in the death of her 15 year old son Timothy Ferguson. Timothy suffered months of abuse & torture including hours of long ice baths & being force fed bread soaked in hot sauce.
The previous hearing was haulted as Shanda claimed “she was feeling like garbage - she had a terrible headache”.
She speaks about her life, her “awful time in jail & how she hardly sleeps & eats”. She continued to place for the situation on her ex for “sending Timothy to live with her”, & actually blames Timothy himself. She said Timothy “caused stress and chaos in her life”.

The previous hearing was haunted as Shanda claimed “she was feeling like garbage - she had a terrible headache”.

I honestly cannot believe what this woman did to this poor boy, 15 years old! 15! & when found, Timothy Ferguson weighed just over 60 pounds - merely skin & bones, inside a closet. She gave Timony bread & hot sauce! & other forms of brutal abuse. As Judge Kacel said “Let’s call it what it is, it is torture!”
Judge Kacel also said “I’m choosing also not to remember your son dead, and looking like a holocaust victim - I’m choosing to remember him like that! A beautiful child with alot of life in his eyes!”

Her former attorney Fred Johnson, took the stand today to testify at her hearing.
When Johnson delivered closing arguments at her 2023 trial, Shanda was not present in the courtroom due to an alleged “significant turn in her mental health”.
Johnson told the jury Shanda “committed manslaughter - but didn’t intend to”. Shanda’s new attorney Ronald Ambrose said that “Shanda has steadfastly maintained her innocence - she has never consented to that kind of argument & never consented to a lesser-included offense”.
Mr Johnson agreed & he testified today at the new trial hearing that Shanda “never gave him permission to make the statement in his closing arguments”.

SHANDA TAKES THE STAND ‼️
Shanda briefly took the stand today. She was asked about her medical condition.
She said “I’m miserable, I’m lightheaded, my head is just splitting, the back of my neck hurts constantly, it’s something that goes along with the thyroid issue I guess….. I’ve been shaking, this is almost constant now”.
She said it would be her preference to testify another time “I feel like garbage”.

Judge allows the states witness and says the defense has the right to prepare for this witness (agree) so court has adjourned for the day. New date for 2nd part of this hearing is TBD by the judge.
