Exactly. “Best interest” is a legal smokescreen, vague enough to justify anything and broad enough to protect everyone except the victim. It gives them cover to ignore undue influence, override capacity concerns, and greenlight exploitation. especially when the abuser has a law license or family tie.
In Florida, § 744.361(4), Fla. Stat. requires guardians to act in the “ward’s best interest,” but offers no clear standard, Without enforcement or accountability, it becomes a loophole for legalized abuse.
Forget about law enforcement. @HCSOSheriff , @fdlepio act like they get to decide what laws matter, when their job is to enforce them, not interpret or ignore them.

My father’s situation was essentially one in which an informal #SupportedDecisionMaking arrangement was established. I can tell you from first-hand experience that it does not protect our #Seniors against #UndueInfluence, #CoerciveControl, predatory lawyers and #ProbateCourt involvement would be a gateway to court appointed guardianship. Predatory people groom for control and use “capacity” as a shield of protection. In fact, imho this is an arrangement that legalizes Undue Influence.

Yikes. Haven’t even read the article but post says #SDM #supportedDecisionmaking goes to #EldercareCoordinator and from the paperwork I see in FL, next step upon non -resolution (likely w those types of perps) is guardianship. I see $ extraction from family, not just elder estate, lack of transparency /info control in Eldercare coordinator process which will likely dovetail to the infamous family court and start from ground zero. Everything in Elder are coordinator meetings stays behind closed doors.
So if you plan to go pro-se, they’ll still get you if the Family court orders parent coordinator which can last up to two years. Check out my prior posts via search icon.
