The Supreme Court’s landmark order on the Waqf (Amendment) Act 2025 marks a resounding victory for justice, constitutional values, and the protection of fundamental rights. Acting on our petition under the leadership of @TVKVijayHQ, amongst others in the batch, the Hon’ble Court has stayed provisions that would have gravely undermined fairness, equality, and religious freedom.
1. The Court stayed the condition mandating that a person must have been a practitioner of Islam for at least 5 years, until State Govts frame rules to determine this question. Without such a mechanism, the provision was arbitrary and unconstitutional.
2. The Court stayed the provision permitting the Government to derecognize a Waqf property during pendency of an encroachment dispute before a Govt officer. It held that empowering Collectors to decide such disputes violates the doctrine of separation of powers. The status of disputed Waqf land will remain unaffected until adjudicated by a Tribunal or Court, and no third-party rights can be created in the meantime.
3. The Court directed that in the Central Waqf Council, non-Muslim members shall not exceed 4, and in State Waqf Boards, non-Muslim members shall not exceed 3.
