Re: storm chase licensing and restrictions...It’s probably easier to just write this here than to try and interact with individual people on #WeatherTwitter. On the topic of storm chaser licensing or carte blanche prohibitions within entire state boundaries, owed once again to recent incidents in certain states, there absolutely are legitimate constitutional issues with trying to do so in respect to the manner that some proposals have taken.
Yes, governments can constitutionally require certain types of licenses as they do to operate automobiles, fish and hunt, or operate watercraft, for example, so all licensing in and of itself is not unconstitutional. However, what’s unique in this particular aspect is that, first and foremost, the US Supreme Court has recognized that there exists an unenumerated, albeit fundamental (negative liberty) right to travel (this has three components as SCOTUS opined in Saenz v. Roe), i.e., persons can move freely amongst the individual states (see Ward v. Maryland and also the United States v. Guest - in part). This is derived from the Privileges and Immunities Clause in Article IV of the federal constitution and also the 14th Amendment. Concomitantly, a state’s requiring some sort of license or permit akin to a “toll” to visit or travel for said recreational purposes on public right-of-ways, many which receive federal funding, within the entire boundaries of said state or states infringes on the Privileges and Immunities Clause and the fundamental right to travel as it is a form of discrimination against non-residents.
While states CAN require activity-specific licenses within their borders (e.g., licenses for fish and game or boating), these are tied to protecting public resources and conserving natural habitats. I don’t have to have a permit to enter Kansas or Oklahoma and photograph wildlife. Merely observing atmospheric conditions or chasing water vapor does not harm natural ecosystems or threaten wildlife habitats. Storm chasing is all tied to free travel on public right-of-ways and thoroughfares. The public has an absolute right to travel on rivers too for commerce or recreation (boating, fishing), and while you may need a boating license as you do a driver’s license, access to all rivers in certain states are not restricted entirely on the count of the purpose of the user, for example. The Supreme Court has long held that the right of nonresidents to “ply their trade, practice their occupation, or pursue a common calling” is a fundamental right protected by the Privileges and Immunities Clause as well (see Hicklin v. Orbeck). Thus, a blanket proscription against chasing within a state’s borders would infringe on that for some in the community, at least those for whom it specifically applies.
None of this is to say, however, that certain conduct cannot be regulated. It absolutely can. Traffic laws and parking regulations can be enforced without impunity. Roads and highways can be blocked or closed. Public safety entities can regulate ingress and egress to certain areas in emergency situations and you’ll have to comply or face appropriate sanctions. None of that is debatable. There is clear precedent for that. However, blanket restrictions on accessing public right-of-ways for specific purposes such as storm chasing runs into serious constitutional concerns and is unlikely to be sustained by the federal courts.
