Fun fact: Elizabeth Warren's husband, Bruce Mann, was my property law professor in law school. He and I exchanged an infrequent but friendly correspondence in the years after I graduated. In May 2019, I sent him this email message (copied and pasted verbatim): "Dear Professor Mann, It has been a while since we have connected. You may remember that I sent you an email when Senator Warren was elected to the Senate. Just as a brief reminder, I was in the U. Penn. Law class of 1999. You were my Property professor and I later took your Trusts and Estates class. I am writing about a sensitive topic, and with a request that you pass this information along to the Senator. I realize that this request is a bit unusual, but I am doing it because it is a matter of urgency. The bottom line: The Democratic party is pushing the narrative that “transgender” and “queer” belong in the same category as gay rights, and that is problematic for several reasons: (1) it is not true, (2) it is bad for women and girls, and (3) it is likely to lead to a loss in 2020. Please allow me to explain. The phrase “LGBTQ” has become so normal as to be sacrosanct in the mainstream left. But those who utter it rarely question what it actually means. We know that the L stands for lesbians, that the G stands for gay men, and that the B stands for bi-sexual men and women. But what do the T and the Q really signify? It’s a bit of a mystery, really, but the inclusion of these letters in the acronym is rarely questioned. There are many reasons to question the inclusion of the T and the Q, but my primary concern has to do with the rights, privacy, and safety of women and girls. It has become dangerous in mainstream society to raise these concerns. Most Democrats do not know any of this because there has been a near total media blackout of our concerns. I assure you that I have not become a right-wing reactionary. I remain a faithful Democrat, and I will probably vote for the Senator in next year’s primary. I am concerned about this issue, in part because I fear that Democrats’ commitment to including the T and the Q will destroy our party. The simple truth is that humans can't change sex, or be "born in the wrong body." I know that Democrats want to be compassionate and to treat everyone with respect. Those values are important. But they need not stand in the way of our questioning what we are doing in the realms of law and policy. The T and the Q threaten the rights, privacy, and safety of women and girls. These issues are particularly important today, when abortion is under attack. It is no mystery that abortion is a service that only women need. Women need to be able to fight for our rights as women. The left’s focus on the T and the Q is a complete distraction from this important issue. I would like to share some resources with you for your consideration, and respectfully ask you to pass these along to the Senator. Here is a recent video clip of me at a press conference in opposition to the House passage of the Equality Act. Aside from some shenanigans involving an ambulance, I start at around 2:55. Here is an amicus brief that my organization, the Women’s Liberation Front, submitted to the Supreme Court in the case of Doe v. Boyertown. I would like to draw your attention specifically to pages 21-23, where we address the relationship between civil rights and subjective feelings (but please do read the entire brief if you have the time and inclination). I am attaching the written testimony of Julia Beck, a Democrat, who testified before the House Judiciary Committee regarding the redefinition of sex to mean “gender identity” in the Equality Act. Here are some stories about men who have committed grievous crimes against women in prisons - these are men who “identify as women,” and who were granted the right to be housed in facilities designated for women on the basis of their self-identification as women. These incidents occurred in Massachusetts, New York, and California. The Massachusetts case is Kosilek v. Spencer. In 1990, Robert Kosilek garroted and nearly decapitated his wife, Cheryl McCaul, and abandoned her body in a mall parking lot. He was sentenced to life without parole. While in prison, he began identifying as a woman, changed his name to Michelle, and sued the Massachusetts Department of Corrections for a sex change operation. Kathleen Dennehy, DOC Commissioner, was reported as arguing that, “Kosilek would be at risk for sexual assault if she were to remain in a male prison, and housing her in a female prison would come with its own host of problems. Specifically, Dennehy anticipated ‘serious climate issues’ since the majority of the women at MCI-Framingham had histories of trauma and it was well known that Kosilek had killed her wife. The women might pose a threat to Kosilek and vice versa.” The gender identity provisions of the Equality Act would allow Kosilek to demand immediate transfer to MCI-Framingham. In 2012, the Senator helpfully expressed disagreement with the District Court’s decision to order Kosilek’s surgery. The reason that most people do not know about these cases is that the media does not generally report on these matters. Here is the case of Karen White, in the UK, who was a convicted sex offender, and who sexually assaulted two female prisoners after he was transferred to a women’s prison on the basis of his declaration that he “identifies as a woman.” These stories are not anomalous. I have personally spoken with two women who are incarcerated in Texas, and who were forced to share a locked cell with a man on the basis of his self-declared status as female. These women were terrified. There is much more to be said about this topic, but I will stop here. My request is that you share this information with the Senator, and that she consider all of this information both in her capacity as Senator (as the Senate considers passage of the so-called Equality Act) and in her capacity as candidate for the Presidency. It would be extremely helpful if Democratic candidates would stop saying “LGBT” and simply champion our support for gay rights. I am available if you have any questions or would like to talk further.
