Free speech must be actively protected against forces that want to promote certain narratives and have power.
And free speech in medicine and with regard to health and your body is paramount because it affects your health and the health of generations to come and the consciousness of society.
We filed an exciting (but frustrating) cert petition this morning concerning the scope of the government speech doctrine. The 9th Cir. held that continuing ed courses for physician licensure are gov. speech so the 1st Amend. doesn't protect instructors from being compelled to include controversial topics like implicit bias training in the courses they teach. We represent @AzadehKhatibiMD and @donoharm in challenging this imposition on instructors' speech rights and hope the Court will correct the 9th Cir.'s severe reduction on protected speech. In an unconstitutional move, the state of California has hijacked the private continuing medical education (CME) system to further its aims. No government should mandate the speech of physicians, including when they are teaching other doctors. @CAgovernor @GavinNewsom signed this terrible law, once again violating the free speech rights of physicians illegally as he did with #ab2098.
I’m fighting back along with @donoharm and the wonderful legal minds at @PacificLegal Foundation.

If the federal appellate court upholds the CA #ab241 law by saying that doctors teaching CME are speaking on behalf of the state, the government can make a law mandating that doctors teaching other doctors have to say that ivermectin should not be used for Covid. And pharma and corporations can lobby for laws mandating doctors’ speech for their aims. #dystopia
If it were up to me, all healthcare providers would be required to take a CME on ivermectin. At a minimum, the @US_FDA needs to make a statement to try to reverse the damage they caused with the horse tweet.
