2.7 What if the Service does not conduct the mandated protection determination during the 90-day period set by #BorderAct -- well the person does not have to go through the new more stringent CFI standard at all but "shall be referred for protection merits removal proceedings in accordance with 240D". Again no discretion granted to Service; miss the 90 days deadline -- jump to the next step and now the person gets a work permit. Now talk about a safety valve!

2.1 Keep in mind that this bill makes no changes to sec 240 [regular removal proceedins] and other than changing the standard for CFI, no meaningful changes to sec 235 [expedited removal proceedings].
Thus, if this is to become law inspecting officers keep the authority to place ppl in 240 and regular 235b proceedings **in addition to the new provisional removal proceedings**.
Also this bill does not mandate any detention other than what is part of 235, 236, and 241.
The Provisional Removal Proceedings accomplish 2 things:
* eliminate the parole or release at border w NTA or Notice to Report
* moves the flow of arriving migrants away from EOIR into DHS exclusive jurisdiction by creating a parallel "rocket docket azylum 'EOIR'" body under the supervision and authority of DHS sec rather than under DOJ's.
