#RDNH #brytebyte.net denied. The Complainant, a South African commercial risk and insurance company, holds registered trademarks for #BRYTE in multiple African jurisdictions (South African registration - December 13, 2018) but has no registered rights in the United States, the European Union, or any jurisdiction outside Africa. The Respondent a US-based IT professional in Washington, registered #DomainName in February 2025 and operates an active IT consulting business under the brand "BryteByte", offering website design, data migration, cloud delivery, and security services, entirely unrelated to insurance.
The Panel found the Respondent had established rights and legitimate interests under Policy paragraph 4(c)(i), noting that "BryteByte" is an independently coherent technology brand combining a phonetic variant of "bright" with "byte", a standard computing term, and that multiple unrelated third-party businesses, including BRYTEBYTE LTD in the UK and Bright Byte Consulting, Inc. in Atlanta, have independently adopted phonetically equivalent names in the technology sector. The Panel further found no bad faith registration, holding that a US-based IT professional had no reason to be aware of a South African insurer with no US trademark, no US advertising, and no meaningful US consumer recognition.
Panel also found #RDNH against the Complainant, noting that the Complainant's own evidence showed a bona fide active IT consulting business, that competent IP counsel ought to have identified the geographic limitation of the BRYTE mark and the existence of multiple third-party "BryteByte" users before filing, and that the assertion the Respondent was "undoubtedly aware" of the mark was made without any evidentiary support and was implausible on its face @ https://t.co/uV2fGp3546
