Complainant REINSCH, INC. / Tri-State Communities LLC (Virginia) claimed common law rights in the #CHAINBRIDGEESTATES mark for a luxury Northern Virginia retirement community, but could only point to an Instagram page with 708 followers, a Facebook page with 51 followers, and a website, falling well short of establishing secondary meaning. Crucially, the Respondent Tony Rivera was the founder and manager of Tri-State Communities LLC and registered the domain in October 2021 in that very capacity, predating any possible trademark rights, facts the Complaint conspicuously omitted, portraying Respondent as an unrelated third party. The three-member Panel found this was a business dispute between former partners over control of a development project, not #cybersquatting, and rejected Complainant's legally-represented argument that a domain renewal constitutes a new bad-faith registration, a position flatly contrary to settled UDRP precedent.
