Important to note that here in NSW there has been significant reform. Notably #DBPAct. Yet:
- Coordination not clearly defined or allocated to any profession.
- System still reliant on self certification ‘I declare that I have done the right thing’… without independent review.
@ssd_studio @Gonzalo1301 Not to mention the unreasonable burden of risk, particularly when the developers themselves don’t get a mention in the #DBPAct.
@Gonzalo1301 You won’t get any disagreement from me. #DBPAct is silent on this issue. Isn’t that telling?
Some interesting developments with provisions of the #DBPAct being tested in court. Key takeaway (unsurprising given construction of legislation) is you could *personally* be liable for costs associated with defects rectification. 👀https://t.co/z7OIEZxj3u
@pleasedontatme Yes! This has been particularly noticeable with introduction of #DBPAct but also with introduction (and subsequent removal) of Home Owners Warranty Insurance from 4+ storeys - effectively penalizing dwelling types 3 storeys or less.
Today we launched public consultation on the next phase of building reforms under Construct NSW. The proposed reforms build on the #DBPAct and #RABAct to ensure that across NSW building work is carried out by competent people and is compliant. #NSWFairTrading
#DBPAct - an important discussion to have - from a an architect with years of experience outlining the contradictions of a legislation (albeit well intentioned) to clean up apartment construction. Key question; Is there a misdirection of responsibility? https://t.co/2JPKw10M0T
3/3 Review #DBPAct and planning acts to cut duplication towards streamlining submission and approval processes. Currently prohibitively inordinate amount of paper work and time for say a duplex or manor house that fails to understand building as complex assemblies *not* products
I have started some research to understand the erosion of medium density housing. Most noticeable is significant decline of up to 3 storey apartment approvals following #DBPAct from about 140 dwelling approvals/month over several years to about 40 post DBP introduction.
@ssd_studio Probably. I’m sure they were already doing that work. But I suspect decision making driven by developers with an understanding that #DBPAct complicates approval process and amplifies obligations. Not sure if I can find a data set to distinguish.

Haven’t posted in while but this one is worth talking about. Hoping that some greater common sense will prevail regarding the application of the #DBPAct. Comments and discussion certainly welcome! https://t.co/ISmcLwI3df
No response from Fair Trading but I am thankful of the @AusINSArchitect for pursuing this line of questioning with the #DBPAct Commissioner’s Office in trying to better understand the scope of declarations requiring preparation by Architects as “Registered Design Practitioners”.
Has Anyone looked at the ‘Design Compliance Declarations’ template for the #DBPAct. Very naive construction that underestimates the number of standards, BCA provisions, associated building layout, geometry, construction and materials that go towards satisfying BCA. 1/5
Ok. Just realized it’s been a week since I asked this of the NSW Fair Trading empowered with implementing the #DBPAct. No response (yet). If they can’t answer some pretty straight forward questions about the scope of Architects declarations and how to complete them then who will?

1/3 Question for those influenced by the new #DBPAct. Trying to understand the scope of the architect’s declarations. Which building elements do we declare? Waterproofing - yes | building enclosure - yes | but also implied by DBP ‘guidance document’ any ‘fire safety systems’.
