Back in 2011 O’Connell was charged w/2 counts of aggravated rape of a child under 16, 2 counts of paying a fee for sex and cocaine trafficking (18 grams of cocaine).
The prosecution charged that the girl and O’Connell, 73, had a “sexual relationship” over several months in 2009, when she was 14.
In 2013, a special prosecutor and a lawyer for O’Connell, presented a plea agreement to a Norfolk County Superior Court judge that requested to drop all charges against O’Connell, including four statutory rape counts and a cocaine-trafficking charge.
In exchange O’Connell would plead guilty to cocaine possession…..but not trafficking (possessing more than 14 grams of cocaine is considered trafficking in MA but the special prosecutor said there was not suitable evidence to prove O’Connell was distributing it).
Why was a plea presented by the special prosecutor and O’Connell’s lawyer?
Because the then 14 year old, now 17 year old girl (in 2013), was killed in a fiery car crash (in a car not belonging to her) in Malden at 3:30am and investigators deemed there was no foul play.
The statutory rape charges were immediately dropped due to her death.
The minors death meant statements she made to investigators about her “relationship” with O’Connell could not be admitted as trial evidence.
Charges were also dropped by the special prosecutor, against Phyllis Capuano, a 22-year-old from Everett who was charged as O’Connell’s co-conspirator in the initial alleged assault against the minor.
Who was the Special Prosecutor that agreed to this plea and dropped charges against the alleged predator and his co-conspirator?
Andrew Berman, a special prosecutor assigned to the case by Norfolk County District Attorney Michael Morrissey himself.
Morrissey got himself tangled in O’Connell’s case from the very beginning and it wasn’t until the SJC stepped in, that Morrissey had to appoint Berman to the case.
The search warrant affidavit in the statutory rape case contained explicit descriptions of sexual interactions the alleged victim says she had with O’Connell. A search warrant affidavit is a public court document.
O’Connell’s attorneys and the NCDAO fought to keep the document impounded until trial, arguing its release would jeopardize the girl’s willingness to testify and O’Connell’s right to a fair trial and taint the jury pool. They also argued a district court judge abused his discretion in ordering the impoundment to be lifted.
The Supreme Judicial Court findings are attached in photo 1, but in short the SJC said “NOPE!” To the impoundment and the search warrant affidavit became public. Morrissey had to recuse himself from that point as his connection with O’Connell was shining bright upon this situation.
