Its Wednesday and we might as well start with good news, as the 5th Circuit Court of Appeals just sent back to US District Court for reevaluation of a seemingly innocuous investment case that had already been decided...but the Appeals court said no no no in the wake of "Loper v. Raimondo" you need to not accept the agency's contentions; in short, do over, and let the US District Court evaluate if "Loper" should change the decision....(I'm broadly paraphrasing here...but it shows that the US Courts are now no longer using the rudder trim tabs to make changes - they are going "right full rudder" and insisting on a Loper review...)
Back to the business at hand:
I am in the hunt for a few things prior to my move on FINRA (FRCP 27, FRCP 34) for the #bluesheets for MMTLP (this weekend I'll be writing the "Ex Parte Motion to Compel the Production of Documents Pursuant to FRCP 27 and 34" based on Sam Draddy and FINRA not complying with my original FRCP 27 and perhaps the MMTLP community can assist as it will benefit everyone long term:
1. Copies of statements of anyone's 401K/IRA/public or private self-directed or union retirement account showing MMTLP as a component in any brokerage house, but I am specifically looking for eTrade accounts or accounts that eTrade manages or is in any way, shape, or form connected to via contract out of a union or private employer retirement plan.
2. I need broker-dealer refusal letters or emails where they would not answer questions as to whether they oversold MMTLP or even had legitamate 211's to trade MMTLP. If you have them, forward to me. (Only a handful of MMTLP shareholders have done this, and I have no idea what the others are waiting for. Its good grist for the mill and in my less than professional but somewhat educated humble opinion it gives people a litigation hook at the very least against their broker-dealers for fraud.)
3. Any copies of trading details showing you had shares of anything trade on market designator "XADF," immediately prior to 9 December 2022 or even to this day. Look at your trades please...or know of anything that has crossed XADF. Any ticker.
4. The original D-1 for MMTLP and then the altered D-1. I need all documents to have dates and links if you have them.
5. Long term: DM me if you have any oil and gas expertise and are qualified to testify as an expert witness in evaluating oil and gas field survey reports, resource estimates, and industry "best practices" vis a vis the most recent Next Bridge statements regarding the value of the deposits.
6. DM me if you are local to the Next Bridge holdings.
7. DM me if you have seen your CUSIP in your brokerage account change in the last 30 days.
8. I need to know EXACTLY who was on the FINRA Board of Directors (not the UPC U3 halters) on 9 December 2022 and the following questions answered:
a. How many were by FINRA rules supposed to be on that BOD if properly constituted?
b. Who were they, what were their names, and who did they represent on the board(retail, industry, banks, at large or reasonable facsimile thereof?)
c. What was their background?
d. What was the exact number of BOD members by FINRA rule that were supposed to be on that BOD if properly constituted?
And finally:
9. I believe "Prometheum" was fast tracked by the SEC as the first "Special Purpose Broker-Dealer" specifically because they will replace the "warehousing" of trades by converting FTDs into "crypto based securities" or some sort. They will become a place for naked shorts and FTDS to be hidden in the matrix, more or less...if anyone with an 80 pound head can venture to "Red Team" this and explore every rabbit hole possibility that MAY provide a way for FINRA, GTS,and the 105 broker-dealers to hide oversold long positions and the horrific levels of naked shorting in MMTLP, please wargame this.
