LEGAL ACTION & FIR DEMANDED AGAINST ASSISTANT COMMISSIONER,DO AE, JE OF T-WARD (BMC) & ILLEGAL ENCROACHERS
I had lodged a complaint on X regarding illegal construction and encroachment on government land (Property 7×12 =84sft Plot) in Mulund T-Ward. As per law, maintaining complainant confidentiality is mandatory. However, BMC officials leaked my identity and phone number to the illegal encroachers and contractor.
Following this leak, I was offered bribes ("take money and drop the issue"). Upon my refusal, I faced severe harassment, threats of false legal cases, and blackmailing. Instead of acting against the crime, BMC officials are actively pressuring me to drop the matter, indicating massive corrupt financial nexus and collusion.
LEGAL OFFENSES APPLICABLE & DEMANDED CHARGES:
1. Section 120B / 61 BNS (Criminal Conspiracy): Between corrupt BMC officers, contractor, and encroachers
.
2. Section 308 / 303 BNS & Prevention of Corruption Act (Extortion & Illegal Offer/Bribery): For offering illegal gratification and subsequent coercive tactics.
3. Section 351 BNS (Criminal Intimidation) & Blackmail: For threatening and harassing the complainant.
4. Section 318 / 319 BNS (Cheating & Fraud): Encroaching upon public/government property for unlawful financial gain.
5. Section 52 & 53 of Maharashtra Regional and Town Planning (MRTP) Act, 1966: For unauthorized development and illegal encroachment on government land.
6. Breach of Confidentiality & Misconduct under Service Rules: Disclosing complainant details to perpetrators.
MY IMMEDIATE DEMANDS:
1. Immediate demolition and removal of the illegal encroachment/construction on government property.
2. Registration of an immediate FIR against the contractor, encroachers, and involved individuals for blackmail, threats, and illegal encroachment.
3. Immediate Suspension and departmental inquiry against the Assistant Commissioner, AE, and JE of T-Ward for corruption, leakage of confidential information, and shielding criminals.
