I must make a correction regarding my previous statement concerning the Carter case. A few days ago, I mistakenly referenced a leading case, unaware that there are actually two distinct Carter leading cases—one pertaining to criminal evidence and the other to MAiD (Medical Assistance in Dying). I was attempting to establish a connection between the MAiD-related Carter case and the current court case, but I encountered difficulty in doing so. Consequently, I sought clarification by speaking with Defense Counsel Magas today, and she provided me with the accurate case reference for the Carter challenge. Supreme Court of Canada R. v. The jury, in effect, was left with the direction that the more onerous standard applied before the hearsay exception could be relied upon.” A Carter challenge entails a party seeking an exception to the hearsay rule, which can be granted by Justice Perkins-McVey subsequent to the assessment of the two aforementioned steps. These steps are concurrently being evaluated during the "voir dire" process. In essence, the Crown attorney is endeavoring to utilize statements made by Chris as evidence against Tamara, and vice versa.
