The HC judgment requires you to comply with #IPILRA in obtaining consent from the #Xolobeni community. #IPILRA requires consent be obtained "IN TERMS OF THE CUSTOMS & USAGE of a community". You cannot dictate to the community how engagement must happen & consent is obtained

The North Gauteng High Court judgement says "We are obliged to obtain consent of the community prior to granting of any mining right in #Xolobeni" It is important for us to consult with the community in order to hear their views on this matter.

The Constitution recognises & protects customary law & rights held in terms of customary law. #IPILRA (giving effect to ss 39(3) & 25(6)) recognises communities like #Xolobeni -who govern their land in terms of customary law- have valid systems to make decisions about their land

The Department of Mineral Resources, @DMR_SA, will commission an independent survey to be undertaken in #Xolobeni. On the basis of the outcomes of the survey, we will then take a firm decision on the way forward
