⚖️COURT UPDATE⚖️Jennifer Hough has filed her RESPONSE opposing Kenneth Petty’s request to pursue SUMMARY JUDGMENT on all four remaining claims in their federal lawsuit. And Hough is not merely asking the Court to reject Petty’s arguments. She is also asking for permission to CROSS-MOVE for PARTIAL SUMMARY JUDGMENT against Petty on her assault-and-battery claim. The response was filed September 28, 2026 in the Eastern District of New York. Hough argues that Petty’s proposed summary-judgment motion presents disputed facts and credibility questions that should be decided by a JURY, not resolved by the judge before trial. One of the biggest disputes concerns the alleged 1994 recantation letter. Petty previously argued that Hough signed and notarized a document saying portions of her allegations were false and that he was “not a rapist.” Hough now disputes that the document is attributable to her and argues Petty would first have to AUTHENTICATE it. But Hough makes another argument: Even if the document is authenticated, she says its own language does NOT establish a consensual sexual encounter. According to her response, the document says Petty did the following👇🏾👇🏾👇🏾 • Would not let her leave • Told her she could leave if she had sex with him • Would not allow her to go home until they had sex • Was told she did not want to have sex again Hough argues those statements describe COMPULSION, not undisputed consent. She also relies heavily on Kenneth Petty’s 1995 GUILTY PLEA. According to Hough’s filing, Petty admitted under oath that he was guilty of Attempted Rape in the First Degree and that he attempted intercourse with Hough by “forcible compulsion.” Hough says Petty also admitted that he grabbed her, threw her onto a bed, attempted to rape her and possessed a long knife in the bedroom. Her attorneys argue that Petty should be legally PRECLUDED from relitigating facts that were necessarily established through that guilty plea. Hough therefore wants permission to cross-move for PARTIAL SUMMARY JUDGMENT on her assault-and-battery claim and for an order establishing the issues necessarily determined by Petty’s conviction. The filing also attacks Petty’s argument concerning whether a GUN or KNIFE was involved. Hough says those accounts are not necessarily contradictory. According to her response, the same-day report allegedly describes an unidentified blunt object pressed against her back accompanied by a clicking sound, which she believed was a gun. Separate records allegedly state that Petty later possessed a large knife and told her she could not leave. Hough says any inconsistencies among witness accounts create credibility questions for the JURY. She also rejects Petty’s STATUTE OF LIMITATIONS argument. Hough argues that New York’s Child Victims Act revived previously time-barred claims arising from the alleged 1994 sexual abuse and notes that her lawsuit was filed during the applicable revival window. On her Negligent Infliction of Emotional Distress claim, Hough disputes Petty’s argument that the claim was previously dismissed or is untimely. She points to alleged conduct from AUGUST 12, 2021 involving an individual she identifies as Petty’s intermediary and argues that the December 2023 Second Amended Complaint was filed within three years of that alleged conduct. Hough also cites Petty’s deposition testimony that he gave Barry Dukes his wife’s telephone number to pass along to Hough, arguing that testimony may support her allegation that Petty participated in efforts to communicate with her. request to accept the late response.
