"Often when our clients have been the victims of further violence & they have not been able to take the contravention application, perpetrators are emboldened by that process – they are getting away with what they are doing" said Gabrielle Craig (@womenslegalnsw) #parentingorders
"There's a mismatch between what the contravention regime is intended to do, and what families might be seeking to do," said Dr Rachel Carson (@FamilyStudies), explaining parents & carers were often seeking a variation to #parentingorders seeking to deal with underlying issues.
"Children also suffer from litigation fatigue" and are "aware of the conflict" and that they are "the centre of the conflict", said Donna Smith (@LegalAidNSW) adding, "They're often quite pleased that the conflict is over." #parentingorders
"The three main drivers of non-compliance were concerns related to abusive, controlling or vindictive behaviour; very difficult relationship dynamics, including fear, #DFV & safety concerns; and orders that do not suit the needs of children", said @DrRaeKaspiew. #parentingorders
“This research demonstrates we need a shift in the response to complex families in the family law system, particularly in terms of providing trauma-informed and child-centred responses,” said @ANROWSCEO Padma Raman PSM. https://t.co/A9RDU3ZOOl #parentingorders
The research also analysed what contributes to non-compliance with #parentingorders, including parenting orders not meeting the needs of children, and concerns about domestic and family violence and safety.

Today, in partnership with @FamilyStudies, we are releasing the final report from the “Compliance with and enforcement of family law parenting orders” project. #parentingorders
https://t.co/jAKHJ9NQd7
The report is focused upon experiences reported by legal and non-legal professionals. Findings based on the views of parents and carers; and data from a court file study will follow in a final report released later in the year. #parentingorders https://t.co/8GKsD33ulG
A key recommendation stemming from the study is that the process of developing parenting orders needs to be attentive to the needs and views of children and young people in order to reduce non-compliance driven by children and young people themselves. #parentingorders

By contrast there was substantial support among professionals for a greater emphasis on problem-solving and therapeutic approaches to address the underlying causes of non-compliance with parenting orders. #parentingorders

Legal and non-legal professionals expressed significant concern that the punitive aspects (fines and imprisonment) of the parenting orders compliance regime are incompatible with a response that is in the best interests of the child. #parentingorders

The study found that for both judicial officers and other family law system professionals, a tension can arise between the punitive aims of the contravention regime and child-focused decision-making. #parentingorders

“The research shows that the drivers of non-compliance with #parentingorders are complex. Systemic issues contribute, including shortcomings in the responses to #DFV & safety concerns & limitations in the way the system supports the participation of children," Dr Kaspiew said.

The study, led by Dr Rae Kaspiew and Dr Rachel Carson from @FamilyStudies, involved interviews with judicial officers and a survey of 343 professionals working with separated parents. #parentingorders

“The Government recognises the frustration that parents and others can experience when #parentingorders are contravened,” the Attorney-General @SenatorCash said. “This research will guide work to better ensure compliance with court orders.” https://t.co/AxH8xiLF0L
“This is a significant study, as there is no current empirical evidence on the operation of the contravention regime in Australia,” @ANROWSCEO Padma Raman PSM. The findings precede recent Australian Government changes to the family law system. #parentingorders

OUT TODAY: NEW @ANROWS-funded #research examining the drivers of non-compliance with #parentingorders and the operation of the parenting order enforcement regime in Australia. https://t.co/EFYYst69BK
