#PersonalNote: Chief Justice DY Chandrachud’s farewell struck an emotional chord for many, and I understand why. Watching him complete his final board of the day, rise, bow with a namaskaar, and deliver his ceremonial bench speech, I too felt a sense of sadness seeing such a sharp intellect depart from the institution. Yet, personal sentiments must not blur what is at its core, incontrovertible.
There is no doubt that he may well be among the kindest, most genuinely warm individuals in public life. His demeanour, even his appearance, adds to his charm. But does kindness alone make him an exceptional Chief Justice of India? Does it make him the judge we need to guide the institution through these complex times. After all, we encounter “nice” people all around us. But does being “nice” or “warm” automatically translate to a transformative leader? Does brilliance in particular areas guarantee this? Especially when those brilliant judgments are flipped by the same judge in other cases, especially those sensitive cases?
Perhaps it’s only human to want to see the best in others, yet sometimes this desire can make us accept a lower standard that soon becomes the new bar. Then, when another “nice” person who is slightly better comes along, we hail, we cheer, conveniently forgetting that the bar continues to be so low. Why let it fall in the first place? Hasn’t this been our collective weakness? A “good person” without the moral courage—what good is that in the end?
One might handle tens of thousands of routine bail cases, but when the institution faces its ultimate test—when the full might of the Executive is bent on ensuring that fundamental rights lose their meaning for that one individual who is before that court of last resort—what then? In those moments, should not that very judge boasting to have given relief to a lakh of them, rise to the occasion and wield the wide judicial powers given for *precisely these cases*? Isn’t that the ultimate test of the judge, the institution? Any judge can grant bail in an ordinary case. But only one with integrity and an unshakeable moral compass can stand up to a powerful state and defend that person’s right.
A judge who was unwilling to do this might console themself, ease their conscience, by repeatedly stating examples of how they came to this person’s relief, that person’s relief but through examples of an ordinary case. Yet, deep down, they too know what they have done in those cases that truly cried out for justice. The judge may take solace in knowing that his judgments will be quoted in the future, immortalising him for a foreseeable time, but little do they realise, so will a Arun Mishra’s and MR Shah’s (hopefully rarely). What therefore mattered was that ultimate test of the present. In that test, the promise to be a bulwark was sadly, betrayed.
