Activists of People’s Union for Civil Liberties (#PUCL), #Karnataka, and family members of #Darshan, 22, who died due to the alleged torture by #ViveknagarPolice, have demanded that a judicial inquiry be ordered into the case instead of a probe by the Criminal Investigation Department (CID).
Following the illegal detention and custodial torture of 22-year-old Darshan, who died on November 26, the Viveknagar Police Inspector and three police personnel were suspended on Tuesday.
Addressing reporters here on Tuesday, YJ Rajendra, vice-president of PUCL, alleged that the police have been threatening Darshan’s wife to withdraw the case after his death. She has also been offered money.
Darshan was allegedly illegally detained by Viveknagar police on November 12. He was allegedly tortured and assaulted, and later sent to a rehabilitation centre on November 16. On November 26, he died at the rehabilitation centre, Prof Rajendra said.
PUCL has formed a fact-finding team of advocates and members from various organisations. Though Darshan was illegally detained, the police did not give any memo to his family, PUCL members said.
Darshan’s mother Adilakshmi said though he suffered injuries, the police did not take him to hospital. She did not sign any consent form to send Darshan to the Unity Foundation Rehab Centre, they alleged.
They said SHRC did not take any action against the police personnel for the alleged torture and human rights violation. The government should ensure the safety of Darshan’s family members, especially his wife, and order a judicial inquiry into his death, it added.
Darshan’s wife Ashwini told that police officers visited her house and offered money, asking her not to go ahead with the case. “I don’t want money. I have a two-year-old daughter. I want justice. That is why we are here. No one should face this situation,” she said.
Adilakshmi stated that the police had brutally assaulted her son with lathis and pipes inside the station. They shifted him to the rehabilitation centre to hush up the custodial torture.
Darshan was not given medical help at the rehabilitation centre despite visible injuries and his inability to walk. Darshan had bruises on his chest, swollen hands, injuries on his left leg, and a wound on his shin when he was brought to the government hospital at Nelamangala.
Madanayakanahalli police have registered a case against the Viveknagar police inspector, three policemen, including Pavan, and the owner and staff of the rehabilitation centre under Sections 103 (punishment for murder), 127 (wrongful confinement), and SC/ST Prevention of Atrocities Act.
Four policemen, including the inspector of Viveknagar police station, have been booked for the death of a 22-year-old man, whom they had allegedly detained.
The victim was found dead in a private rehabilitation centre under mysterious circumstances in #Madanayakanahalli on Wednesday.
The victim, #Darshan, is a resident of #Sonnenahalli in #Koramangala. His mother, Adilakshmi, filed a complaint accusing the Viveknagar police personnel and the Unity Social Service Trust Rehabilitation Centre of custodial violence, illegal detention, and negligence.
The victim, addicted to alcohol, was taken into custody by the #ViveknagarPolice on November 12 following an altercation near his residence.
The victim is said to have threatened them by showing a machete.
Three days later, the Viveknagar police had reportedly arranged to admit him to the rehab centre located at Adakamaranahalli.
“My son has been tortured and beaten in custody and later admitted to the rehab. He was not doing. Despite repeated requests, the police did not allow me to meet him. I requested them not to send him to jail, as I would be taking him to a de-addiction centre. Due to the nature of the torture, my son was unable to walk. Police forced me to pay Rs 2,500 for his admission to the rehab. The rehab centre kept claiming that Darshan was recovering,” Adilakshmi told the media.
“On Wednesday, we received a call stating my son had died due to difficulties in breathing. When we rushed to the centre, his body was not there. We were directed to the Nelamangala government hospital, where doctors informed us that Darshan had been brought dead. There were multiple injury marks all over his body, including chest, back, hands and legs,” she added.
Naveen, the supervisor of the rehab centre, told the media that the Viveknagar police called them to admit Darshan.
“At the time of admission, there were injury marks on him, and we have taken photographs of them. After he complained of breathing difficulties, he was first taken to a nearby private hospital and from there to the government hospital. If we are found at fault, we are ready to undergo the punishment.”
“The case was registered on Thursday by the Madanayakanahalli police against the police inspector and three other policemen of Viveknagar station. Even the case is registered against the rehab centre officials. The case has been transferred to the CID for further probe,” CK Baba, Bengaluru Rural District SP, told to media.
An FIR has been registered for murder under the provisions of the SC/ST Act.
