19 Dec. 2024 — The Criminal Court found Arnon Nampa guilty of #lèsemajesté #s112 and #sedition #s116 and sentenced him to 4 years in prison in connection with his #HarryPotter1 speech calling for monarchy reforms. The sentence was later decreased to 2 years and 8 months. Arnon was acquitted of charges under the Emergency Decree and the Sound Amplifier Act.

Regarding charges under the Emergency Decree and the Sound Amplifier Act, the Court held that Arnon was invited to give a speech and was not a protest organizer. He therefore was not guilty of these charges.

With respect to Arnon’s Facebook post, the Court held that, although the post was inappropriate, it was not a crime under #s116 #ComputerCrimesAct.

With respect to Arnon’s #HarryPotter1 speech, Arnon stated that the King interfered with constitutional amendments and people who spoke about the monarchy were mostly killed or enforced disappeared. The Court held that Arnon accused the King with the aim of causing disorder in the society and achieving political changes.

Section 6 of the Constitution prohibits people from violating the King. The Court noted that Arnon is a lawyer and therefore should have known about this provision. Yet, Arnon gave a speech criticizing the King’s work, thereby violating the King and, in turn, Section 6 of the Constitution.

Pursuant to Section 174, para. 4, the fact that there was no examination of defense witnesses affected neither the established facts nor the judgment. Moreover, had the Court subpoenaed evidence as requested by the defense, the Court would be acting in violation of Section 6 of the Constitution. It would also implicate Arnon and related persons in the wrongdoing and cause disorder in the society, adversely affecting public order and the regime with the King as the head of state.

Arnon’s speech tarnished the King’s honor and is not in accordance with the will of the Constitution. As such, it is an offense under #s112 and #s116.

The Court sentenced Arnon on the basis of the most severe offense, which is #s116, to 4 years in prison. The Court reduced the sentence by one-third to 2 years and 8 months.

ตาม ป.วิอาญา มาตรา 174 วรรคท้าย การที่จำเลยไม่ได้สืบพยาน มิได้ทำให้ข้อเท็จจริงและคำวินิจฉัยของศาลเปลี่ยนแปลงไป อีกทั้งหากศาลเรียกเอกสารมาตามที่จำเลยร้องขอ จะเป็นการขัดต่อรัฐธรรมนูญ มาตรา 6 ทั้งจะทำให้จำเลยกับบุคคลที่เกี่ยวข้องมีความผิดและเกิดความวุ่นวายในสังคม ส่งผลเสียต่อความสงบเรียบร้อย และขัดต่อการปกครองอันมีกษัตริย์ทรงเป็นประมุข
การปราศรัยทำให้กษัตริย์เสื่อมเสียพระเกียรติ การกระทำของจำเลยไม่อยู่ในความมุ่งหมายของรัฐธรรมนูญ จึงเป็นความผิดตามมาตรา 112 และมาตรา 116 ให้ลงโทษบทหนักที่สุดคือมาตรา 116
