#Admissibility of #Evidence and #Order of #proof
This section explains the authority of the Judge regarding whether evidence proposed by a party is admissible and the order in which such evidence should be proved before the Court.
Section 141(1)
When either party proposes to give evidence of any fact, the Judge may ask that party in what manner the alleged fact, if proved, would be relevant to the case.
The Judge shall admit the evidence only if he considers that the fact, if proved, would be relevant to the matter in issue; otherwise, the evidence shall not be admitted.
Section 141(2)
Where the evidence proposed to be given to prove a particular fact is admissible only upon proof of some other fact, that other fact must first be proved.
However, if the party undertakes to prove such fact subsequently, and the Court is satisfied with that undertaking, the evidence may be admitted beforehand.
Section 141(3)
When the relevancy of one fact depends upon another fact being proved first, the Judge may, in the exercise of his discretion:
Admit evidence of the first fact before proof of the second fact; or
Require the second fact to be proved before evidence of the first fact is given.
Illustrations
(a)
A statement made by a person who is alleged to be dead is sought to be given in evidence as a relevant fact under Section 26.
Before admitting the statement, it must first be proved that the person is in fact dead.
(b)
The contents of a document alleged to have been lost are sought to be proved by producing a copy of the document.
Before the copy can be admitted, it must first be proved that the original document has in fact been lost.
(c)
A is accused of receiving stolen property knowing it to be stolen.
It is proposed to prove that A denied possession of the property.
The relevancy of this denial depends upon identifying the property in question.
Therefore, the Court may:
Require the property to be identified first; or
Permit evidence of A's denial to be given first and require identification of the property afterwards.
(d)
It is proposed to prove a fact A, which is alleged to be the cause or effect of a fact in issue.
However, before A can be regarded as the cause or effect, certain intermediate facts B, C and D must be proved.
In such a case, the Court may:
Permit A to be proved before B, C and D are proved; or
Direct that B, C and D must first be proved.
In Summary
The objective of Section 141 is to ensure that no evidence is admitted in Court in an irrelevant manner or without the necessary foundational facts being established. At the same time, it confers upon the Judge the discretion to determine the order in which evidence may be admitted and proved, depending upon the circumstances of the case. This is an important provision that helps maintain order, fairness, and procedural justice in judicial proceedings.
