The Canadian Complainant has operated an online dispute resolution platform under the #SMARTSETTLE mark since 1999 and holds a Canadian trademark registration dating to 2004. The disputed domain name was registered in November 2023 by SmartSettle AI, Inc., a Delaware corporation that has used it since 2024 to offer AI-based financial transaction settlement services.
The Panel found the Complainant failed to establish bad-faith registration, accepting that the Respondent's choice of brand was plausible and descriptive in the context of its own industry, that the Parties' websites were easily distinguishable in look and feel, and that the Respondent's industry of AI-driven financial settlement is markedly different from the Complainant's dispute resolution services.
