Why are Ruaka police harassing residents at #TheAlma? Police should not be badging into residential areas without a court order? The thirst to steal from the public is now too much.
Seated waiting for the 49th President of @LawSocietyofKe to consult on a few things:
1. Status of sending @CJMarthaKoome home for tolerating the few corrupt judges soiling the name of the rest.
2. How to send Justice Mabeya home.
3. How to extricate #TheAlma, a project there has never defaulted, no demand and facilities not fully drawn down… from the plunder of the Official Receiver.
4. What little help to make @dkmaraga the 6th.
Fraudulent Official Receiver in order to try and extort rent from bonafide purchasers of #TheAlma is turning off water and electricity on owners…
… as @NelsonHavi would say, the wind will blow and expose their fraudulent ass.
As you can hear from SBM’s lawyer, the bottleneck in this Insolvency proceedings is usually the Official Receiver. But again, SBM Bank sought the fraudulent consent with the OR that Hon. Mabeya order with a one liner ruling.
#TheAlma is only 4 to 6 months from completion to deliver homes, why are we not finishing and overwhelming courts with all these matters? It’s now year 3 since the Official Receiver came on board.

Dear @KenyaPower_Care @KenyaPower , please stop harassing the residents of #TheAlma for a bill they do not owe… you are courting a lawsuit.
When Justice Mabeya condemned #TheAlma unheard, the project stopped and the contractor took off and left an electricity bill on the contractor’s metre. The law is clear you should not harass a consumer for a bill that is not theirs:
“Power supply in Kenya is unique as all Kenyans rely on one dominant supplier who is the Respondent herein, it is surprising as to why it would opt to disconnect power to meters that were not in default of payments and thus inconveniencing a customer on account of a separate meter under a different supply contract. Such an act is not only inconvenient but also oppressive.
30. One contract should not be a reason to disconnect a separate meter under a different supply contract. Those contracts are separate and distinct.” That’s what courts have said, we therefore demand as 👇🏽follows:
As Governor, @honkabogo supported the statutory approvals that would lead to what is now called #TheAlma… Nairobi’s most comprehensive mixed use development. He is focused on delivery and welcomes big ideas. I wish him well on his vetting today.

Please advise your Kiambu office reps to stop harassing the owner of apartment D905 At #TheAlma. You are exposing yourself to unnecessary legal risks as what they are doing to him is unlawful, you know that and that’s why you are unwilling to put it in writing.
I have advised them to quickly contact their lawyers.

On this Labor Day, took time to go see how the works of our hands are holding up during this challenging season.
Very impressed at how the elevated playgrounds at the #TheAlma are holding up during the floody season. Kids can still go outdoors and play on dry grounds:

Random Thought on the #TheAlma issue …LAWLESSNESS IS NOT A SOLUTION.
Because #TheAlma is a matter involving 25,000 Kenyans, shall address it here.
Shocked to hear from #TheAlma residents that there was an attempt by various property agents, ostensibly at the behest of the Official Mortician and SBM Bank Kenya, to access #TheAlma purporting to be executing a High Court order that has been stayed by the Court of Appeal.
The Unholy Alliance gathering around the Official Mortician trying to evade court orders, please just stop - you are breaking the law.
1.For SBM Kenya, we have enjoyed a good relationship. If you have a problem with #TheAlma, face your borrower head on. If you are not happy with the Court of Appeal order, appeal it. Defying court orders is a recipe for chaos. Nothing good can come out of fronting the lawless Official Mortician in outright violation of court orders to try to defeat the ends of justice.
2. For the prospective real estate agents sneaking into #TheAlma to prepare your estimates for your proposal, you are being misled to violate court orders, keep off. Violating court orders will eventually prove more costly than the illicit property management fee you are chasing.
3. For the Official Mortician, it is well known that for an entire decade you have plundered, dismembered and closed businesses contrary to the Public Interest intentions of the Insolvency Act to preserve value, jobs and tax base. For 10 yrs, not a single creditor has ever received a single cent from insolvency nor a single business revived - just outright destruction of value, jobs and tax base. Hundreds of creditors have spoken clearly that they want to complete #TheAlma, hand over homes to buyers, and pay off all creditors. It’s their money and their property, protected under Article 40, we cannot stop them.
For the 25,000 investors, home owners and tenants with an interest in #TheAlma who have been restless, please stay calm, the constitution is very clear on Property Rights and Fair Administrative action, and the said constitution will vigorously defend your interests.
Stay calm, we shall finish the journey!

I have seen this misguided 👇🏽letter making rounds on social media with regard to #TheAlma project.
Because this is a matter of great public interest involving over 25,000 investors, allow me to clarify. There can be OBSOLUTELY NO CONTROVERSEY on the said interim orders… they are as clear as day and night. They were issued by a properly quorate 3 judge Court of Appeal bench. After issuing the interim orders to preserve the subject matter of the dispute, one of the honorable judges recused himself from further hearing the matter.
The alleged controversy does not exist, but if it does then maybe in the mind of the MKU Law graduate authoring this letter. Ours is an appellate judicial system, an officer of the court should know that if they are unhappy with orders, then appeal to the Supreme Court rather than try to scandalize the court.
Given the misinformation flying around on The Alma, I shall now be providing updates on this platform, but WITHOUT litigating the issue in public square. We must do everything possible to complete The Alma, hand over units to innocent buyers for value, pay secured creditors and pay unsecured creditors.
