CHIEF GANI FAWEHINMI, SAN AND THE TINUBU PAPERS
Why 1999 still sits
on the 2027 table
#ProudlyOK #WalkGently
1/8
Before @atiku’s @bbchausa BBC claim.
Before the 2023 CSU deposition.
Before today’s noise.
There was Chief Gani Fawehinmi, SAN.
On 7 October 1999, Chief walked into the Federal High Court, Lagos, and asked
the law to look at @officialABAT Bola Tinubu’s INEC forms.
This is that record. Dates. Citation. Holding.
Then why it still
matters for Atiku and
for @PeterObi.
2/8 — WHAT GANI FILED
Originating summons. Prayer: order of mandamus to compel the Inspector-General of Police and Lagos Police to investigate criminal allegations against the newly sworn
Governor of Lagos.
The two documents
he pointed at:
INEC Form CF001,
sworn
28 December 1998
Affidavit of Lost Certificates, sworn
29 December 1998
The complaints then: alleged false statements on oath about schools attended, which university, and related personal particulars. St. Paul’s / Children’s Home. Government College Ibadan 1965–1968.
University of Chicago rather than Chicago State. Age entries
that did not match.
3/8 — WHAT THE COURTS ACTUALLY DECIDED
Trial court, 14 December 1999: dismissed.
Section 308 immunity.
Court of Appeal, 5 June 2000: Police can investigate a sitting governor.
Section 308 NG. Constitution blocks prosecution, arrest and detention while in office.
It does not block investigation. But no mandamus — police have discretion
under the Police Act.
Some of Gani’s exhibits were uncertified
public documents.
Supreme Court,
10 May 2002.
Fawehinmi v. Inspector-General of Police (2002) 7 NWLR (Pt. 767) 606.
SC.201/2000. Lead judgment: Uwaifo JSC.
Holding in plain language: immunity is not a shield from inquiry.
It is a shield from being charged, arrested or detained while in office. Investigate.
Do not prosecute
until tenure ends.
Mandamus refused. Appeal dismissed.
4/8 — WHAT THE CASE DID NOT DO
The Supreme Court
did not rule that
the certificates
were genuine.
It did not rule
that they were forged.
It did not try the facts
of the schools or
the university name.

The Supreme Court
did not rule that
the certificates
were genuine.
It did not rule
that they were forged.
It did not try the facts
of the schools or
the university name.
It decided a process question: Can you force the police to investigate a sitting governor?
Answer: you can investigate; you
cannot compel them
by mandamus in
those circumstances;
you cannot prosecute him until he leaves office.
Lagos House of Assembly also looked
at the petition in 1999
and did not impeach.
In 2013, a fresh
attempt to reopen
Gani’s complaint was dismissed as out of time.
5/8 — WHY ATIKU KEEPS RETURNING HERE
Atiku has said openly that Gani inspired him
to go after the Chicago State records. That is not poetry. It is lineage.
Gani’s method was: put the INEC form on the table, demand official records, take it to court, leave a paper trail.
That is the same method Atiku used in the US discovery case and
the method behind
the current age and certificate talk.
The 1999 questions
and the 2023–2026 questions are cousins:
what exactly was declared on oath, which school, which university,
which date of birth appears on which paper.
Gani fired first. Others are still firing from
the same trench.
6/8 — WHY IT MATTERS FOR PETER OBI AND NDC @NigeriaNDCHQ
In 2023, Obi called the certificate controversy bigger than politics —
a question for the soul
of the country.
PO submitted
his own papers in full.
He has said
certificate forgery
is a crime, not
a “pre-election technicality.”
Atiku invited Obi & @KwankwasoRM to treat it as a national
integrity fight,
not a partisan one.
Commonsense for NDC in 2026: you cannot build “New Nigeria” on two opposite instincts
at once — demand character from leaders, then treat 27-year-old unanswered paper questions as
mere distraction.
You also cannot let 1999 become the whole manifesto while food, security and school fees burn. Gani’s lesson was balance: use the court,

🙏🏻Fantabulous Father,
As we approach
Jan 2027 Presidential Election in Nigeria🇳🇬,
We commit Nigeria 🇳🇬
into Your hands.
1. For the Voters
Give Nigerians wisdom to choose, not by tribe, not by stomach,
not by noise.
Let us choose character, competence,
and capacity.
Protect every vote.
Let it count.
2. For the Candidates
@PeterObi @KwankwasoRM
@atiku
@officialABAT,
@sowore ,
NDC Leadership
@iamHSDickson
and all who will run.
Purify their motives.
If they want power
to serve, anoint them.
If they want power to destroy, expose them.
3. For Voices & Defenders
Mr Femi Falana SAN,
Amnesty International.
Serap Nigeria. UN. EU.
Human Rights Watch.
Independent Observers.
AU. NGOs. BudgIt et al.
@falzthebahdguy,
VeryDarkMan [VDM],
Seun Kuti. Aisha Yesufu.
Pat Utomi. Peter4Nigeria
and all who speak
for the people.
God, grant them wisdom to know when to speak and when not to.
Protect them from traps, from being used, and from being silenced.
Let their courage build, not destroy.
4. For INEC and Security
Let 2027
not be 2023 again.
No rigging. No violence. No "wuru-wuru".
Let the will
of the people stand.
5. For the Nation
Heal our economy.
Feed our children.
Secure our schools.
Let campaign season
not turn brothers to enemies.
Let us debate policies, not pull each other down.
My Stand:
Though my preferred candidate is still NDC’s PETER OBI @PeterObi,
My prayer is for
🇳🇬NIGERIA TO WIN.
Whoever God and
the people choose,
let them lead with
justice and fear of God.
Declaration
Nigeria
will not bleed in 2027.
Nigeria will choose right.
Nigeria will be better.
