State civil rights law is not a smaller copy of DOJ pattern-or-practice. In Oregon it is mostly **discrimination and public-accommodation statutes**, plus a separate **police-discipline** stack. The Attorney General does not have a clean “sue Eugene PD for a pattern” button.
**Oregon’s main civil rights code: ORS chapter 659A**
Policy is in ORS 659A.006: it is a civil right to get work, housing, or public accommodation without discrimination based on race, color, religion, sex, sexual orientation, gender identity, national origin, marital status, age, or disability (and related protected activity).
Enforcement is through the **Bureau of Labor and Industries (BOLI)** Civil Rights Division, then a possible lawsuit in circuit court. Typical covered harm:
- employment discrimination and retaliation
- public accommodation (stores, hotels, many services)
- housing (often overlapping with federal Fair Housing)
- whistleblower and workers’-comp retaliation
- disability accommodation
Process: questionnaire → signed complaint → investigation → substantial-evidence finding or dismissal → conciliation or formal charges. Time limits are generally long for post-2019 incidents (up to five years for many employment claims). BOLI is built for **an employer or a place of public accommodation**, not for “detectives will not take my Instagram case.”
**Police-specific Oregon rules (not 659A)**
After 2020–21 reforms, officer conduct has its own statutes:
- **ORS 181A.681** — officers must intervene and report misconduct (unjustified force, sexual misconduct, discrimination, or a crime) within 72 hours. Failure can cost certification.
- **DPSST** — Department of Public Safety Standards and Training can suspend or revoke an officer’s certificate.
- **LESC rules** (ORS 243.706, 243.808–243.812) — statewide discipline matrix for proven misconduct (untruthfulness, bias crimes, misuse of authority, etc.).
- **ORS 181A.250** — agencies may not collect or keep files on political, religious, or social views unless tied to a criminal investigation with reasonable suspicion. That is a surveillance limit, not a general “investigate my neighbor” duty.
Home rule matters: Oregon’s AG is a **statutory** office (ORS ch. 180). Legislative history around profiling bills noted the AG has no default power to run city police. That is why Oregon did not copy California’s AG pattern-or-practice statute.
**How that compares with other states**
About ten states gave their AG an express pattern-or-practice power modeled on 34 U.S.C. § 12601. California’s Police Practices Section is the developed version: civil investigation of a department’s systems, then a lawsuit or MOU. New Jersey can go further and *supersede* a department. New York has used *parens patriae* and other tools without the same clean statute. Oregon is in the group that reformed *officer* standards instead of handing the AG a federal-style decree power.

Eugene is a home-rule city. Oversight of EPD is first the city manager, council, and whatever civilian review the city created — not Salem’s AG opening a consent decree.
