🧑‍⚖️上海高院近日发布新规，虚拟货币与数字藏品被列为可执行网络虚拟财产

该指引明确网络虚拟财产包括数字藏品、游戏装备、道具、Q 币、虚拟货币（如 BTC、ETH、USDT 等）等类型，但不包括数字人民币及微信、支付宝等平台内可直接支付结算的电子资产。

指引规定人民法院有权查封、扣押、冻结被执行人实名登记的网络虚拟财产。

针对虚拟货币的扣押，应由执行法院配备冷钱包，并将资产从持有人钱包或中心化交易所转入法院专门设立的冷钱包中存放，严禁执行人员自行存管。

针对委托第三方机构保管的情况，需建立「执管分离」、「多人多锁」和「相互监督」的工作机制。

法院可采取拍卖、变卖或委托网络交易平台回购、寄售等灵活方式。

对于无财产外观载体的虚拟财产，可通过向网络服务提供者发出执行裁定书，以后台修改注册登记信息的方式完成交付。

此外，处置过程中涉及结汇申报时，严禁违反外汇管理及反洗钱等相关规则。
