I had a car accident last week and this week I found out that my ex husband lied about paying the car insurance. He threw my accident in my face like it was somehow my fault that he didn’t pay it and let it expire. I’m now looking at a hefty fine as a parting gift.

See, I've also trained hundreds of soldiers on LOAC in the applied context. Thousands, actually. And I've advised commanders & decision makers on LOAC in combat, in Afghanistan as Chief of International & Operational Law for CJTF-101/RC-E (OEF XIV).
That's why I know the difference between what SECWAR said in a press briefing yesterday & a war crime. Apparently you don't - so I'll do you a favor & spell it out for you step by step, in simple language that you'll hopefully understand.
Let's start off with what Hegseth ACTUALLY said:

Alright, if we consider this "no quarter" observation in context, we see Hegseth's intent is to convey that @DeptofWar is going to exert max pressure on our adversary. We know their military capabilities "are crumbling" & we're not going to back off. Keep pushing, keep advancing.
"No quarter. No mercy."
See, content & intent are important. This is how we differentiate political rhetoric from war crime. Reality from...bullshit.
If we go all the way back to Hague, II (1899) & Hague, IV (1907), the Regulations annexed to both Conventions make it forbidden, "To declare that no quarter will be given" (pic 1, from Hague, IV).
Seems legit, right? Isn't that what SECWAR just "declared"? Well, if LOAC development stopped at 1907, maybe you could make that argument.
But, it didn't. In negotiations for later treaties, delegates decided to be more clear about what exactly that prohibition should entail.
So, next we'll consider 2 later treaties 🇺🇸 hasn't ratified but we were deeply involved in shaping - Additional Protocol I (1977) to 1949 Geneva Conventions & Rome Statute @IntlCrimCourt (1998).
As we'll see below, these sources confirm Hegseth's political rhetoric is NOT a LOAC violation or war crime...and US DoW doctrine is consistent with relevant text of these treaties.
Let's start with AP I. As we see from art. 40, this treaty clarifies (7 decades after Hague IV), "It is prohibited to ORDER that there shall be no survivors, to THREATEN an adversary therewith or to CONDUCT hostilities on this basis" (pic 2).
So, 3 specific verbs to highlight + 1 condition. No ordering, threatening, or conducting (verbs) armed hostilities under condition(s) of NO SURVIVORS.
Now, reach all the way back in your memory - like 2 minutes ago - when you read actual text of Hegseth's remarks.
Do you genuinely believe SECWAR just ordered or threatened there will be no survivors, even if an enemy IRGC member tries to surrender - or that we are now as a result conducting hostilities on that basis? Be honest.
Of course not. And no one in the military is going to hear/read his remarks and think, "SECWAR just ordered me to take no prisoners." Seriously.
Moving on from AP I, art. 8(2)(b)(xii) of Rome Statute essentially copies text of Hague IV, art. 23(d) to make "declaring no quarter will be given" a war crime (not pictured). BUT the elements of crimes follows AP I (pic 3), as does DoD Law of War Manual (pic 4).
Yes, actual no quarter ORDERS do violate LOAC. Just the order alone is a war crime.
But max pressure political rhetoric is not the same as an ORDER "that there shall be no survivors."
Which means Sec Hegseth's comments are neither LOAC violation nor war crime. Which also means Rep Vindman is full of 💩.
@SpeakWithDeeDee The pilot was struck down by friendly fire. I’d know that trajectory anywhere. Anyways Kuwait has one of the many missile ready bases in the Middle East. Service members are rotated in and out all the time. This is something that happens more often than you realize. It’s common.

Trump had the battle won before he fired a single shot. The decisions were already made. What we are witnessing play out is not “war”, but rather a controlled and precise obliteration of the Deep State, mixing military, economic, informational, and psychological elements.
We are witnessing the systematic destruction of the “Old Guard”.
🇮🇷 47 years ago, I stood at a window in Tehran as a 3-year-old boy, smelling burning tires and hearing the chants that would steal my country. I didn’t have words for what was happening. This is the same regime that:
- Armed and cheered the October 7 massacre against Israel for no reason other than pure genocidal hatred.
- Murdered tens of thousands of its own sons and daughters who dared to walk peacefully in the streets demanding the most basic freedoms.
- Gouges out the eyes of young women for the “crime” of wearing makeup.
- Hangs teenagers from cranes for posting a tweet.
- Exports terror, poverty, and darkness to every corner it can reach including the U.S.
No nation, no people, should have to live under that. Not Israelis. Not Americans. Not Lebanese. Not Syrians. And certainly not Iranians.
I am a physician who has spent his life trying to heal bodies and a son of Iran who has spent his life mourning a stolen homeland. What we are witnessing is not aggression — it is surgery. Painful, necessary surgery to remove a tumor that has metastasized for 47 years. The tumor is the Islamic Republic that has hijacked Iran.
To the brave pilots and special operators of the Israeli Air Force and the men and women of the United States military now carrying out this mission: I pray for you with everything I have.
May God shield you from harm. May every missile find its target and every soldier return home safely to the families who love them. You are not invaders. I have lived the stolen life so that others might not have to. Today, for the first time in 47 years, I allow myself to believe that the stealing is almost over.

No, I will not let you be my voice. You don't get to narrate my story, you don't get to claim moral superiority. You don't get to tell me my feelings are wrong.
Is it legal to throw women in prison for strands of hair? Is it legal to mass execute people? Is it legal to turn a fertile land into a parched desert? Is it legal to rape? Is it legal to shoot innocent people? Is it legal to kill children? Is it legal to torture people to death? Is it legal to spread terrorism? Is it legal to deprive people of a livelihood? Is it legal to shoot people in the eye to blind them? Is it legal to silence people and take away all of their human rights? Is it legal to shoot down a passenger plane? Is it legal to drive millions to leave their country? Is it legal to jail women for singing and dancing? Is it legal to disappear people including children?
You will never experience anything like Iranians have experienced for the last 47 years.
Iranians have fought barehanded and they've paid a price. All up to 1,000,000 (one million) Iranians have been murdered since the regime came to power.
Your books on 'civil disobedience' and 'collective protest' are useless against an armed opposition that is ideologically driven and will kill all that stand in its way.
You want legality? The world has a duty to protect innocent lives. It's enshrined in R2P. Some people seem to think Iranians aren't humans. The murder, genocide and massacre of Iranians receives scant media attention - hence scant sympathy.
Those who proclaim to care about 'human rights' must think Iranians are animals and not worthy. Their hatred of Israel and US is so great they've lost all perspective.
Yes, Iranians are happy. They're happy someone took out Ali Khamenei and many others directly responsible for so much pain and agony.
And you know what? We're unashamedly hopeful that with the help of the world's superpower, we can reclaim our country and build a better tomorrow.
We know there's a long way to go, but give us this brief moment of reprieve, because daily we sit and try to tell the story of the lives lost, those at risk of execution, those under torture. We've seen the pictures and videos of massacres taking place.
Our dance and happiness comes with a heavy weight. We do so, in knowledge of the many who never lived to see this day.
The day of freedom will come to Iran, it's glorious - and we're not sorry if some outside help contributed to making that happen.
So don't speak on my behalf and stop excusing this regime on grounds of 'anti-colonialism'. and 'anti-Zionism'.
