@KobeissiLetter I mean it's absolutely not a coincidence. Regulators are very clear that they like to take control of banks on Friday and resolve them on the weekend whilst markets are closed. This is literally bank resolution 101
@jeuasommenulle@cetier1 I'd expect no tax impacts on write-off otherwise you'd have to haircut your at1 as the amount of capital raised on write off is less than face value of the at1
@BondHack Not sure I agree that the emergency reg was the basis for NV. The only way cs could continue was via sale to UBS as announced which included 16bn it equity from the at1. the latter inarguably increased the solvency of CS. Whether or not it was warranted is a separate question
@gianlucac1 The sections you are quoting are talking about resolution where they have no choice but to follow the heirachy. The ball in was done pre resolution. There is a risk factor in the last at1 OC which covers FINMA not respecting priority
@jeuasommenulle Not sure I agree with that article. The regulation was belts and braces it feels. Their argument around shoring up the capital position also feels off - the bailin was needed to get UBS to the table to continue the business. Their beef is with the lack of conversion not bail-in
@jeuasommenulle Isn't it the case that the contractual terms of the instruments don't permit conversion at PONV so write-off the only option here? Seems like a case of investors being surprised that PONV being enforced in these circumstances - i.e going concern not gone concerned
