Courts ensure fair elections, but electoral lawsuits can also be used to attack opponents or discredit the process. For instance, none of the 400+ lawsuits filed before the 2020 U.S. election succeeded in court, and the most recent election saw a similar number of cases.
Should access to electoral courts be restricted to curb abusive lawsuits? Probably notโthey're essential for election integrity. But policies like loser-pays rules, fines for bad-faith cases, or limits on certain pre-election filings could help reduce frivolous lawsuits.
