We had proposed that the country withdraw from the convention to amend articles that will limit the rights of foreign nationals, like other African countries that still have refugee camps, and do not extend the same rights to basic services....

On the issue of citizens directly electing their own President, the legal advisors argued that the matter falls within the mandate of the Electoral Reform Consultation Panel, which was established to conduct a comprehensive review of South Africa’s electoral system and make recommendations on possible reforms.
Their view is that the Constitutional Review Committee cannot create a parallel process while that panel is already considering electoral reform.
What makes this particularly interesting is that the Constitution itself (the supreme law of the land) currently provides that the President of South Africa is elected indirectly by the National Assembly.
This raises an obvious question: if citizens want that constitutional provision changed so that they can directly elect the President, is the Constitutional Review Committee not precisely the forum where such a proposal should be considered?

One of the 11 submissions considered today proposed amending the Preamble to state that “South Africa belongs to its citizens.” The legal advice to the Committee was that this proposal should not be supported.
During the discussions, we heard repeated arguments that certain concerns raised by the public are not constitutional matters, but rather issues that should be addressed through ordinary legislation. We also heard the view that constitutional amendments cannot place South Africa in conflict with its international obligations, including those arising from the 1951 UN Refugees Convention.
PS: There was no feedback on the SACR submission today. The legal team indicated that the submission is extensive and requires further consideration, with discussions expected to continue next week.
Genuine question: was the SACR submission always going to receive this level of attention, or did the pressure campaign and litigation preparations force it onto the agenda?

I agree wholeheartedly with you that our engagements should never descend into ad hominem attacks or belittle education. Education must be valued and defended, for it remains the foundation upon which our children build their futures.
At the same time, it is worth remembering that wisdom is not confined to the classroom. Lived experiences also carry deep insights that enrich society. We must appeal to those who are "educated" to be mindful not to present themselves as the sole custodians of knowledge or to treat others as less wise. They should not speak over communities or appear to be lecturing them on how to advance their struggles.
I am of the view that the in public discourse, the "educated strata" of society should set a good example for children, who each morning commit to the disciplined routine of schooling, by showing respect for the voices and lived experiences of those "less educated". Without such respect, children may grow up believing that disregarding the experiences of the "less educated" is the proper way to engage with others.
My good Dr, I will argue that education achieves its highest purpose when it listens, learns, and collaborates with society in humility. In that way, it becomes not only fashionable, but also inclusive and transformative.

On the submission by Sandisiwe Siphumelele Masuka, a healthcare worker, the proposal is that the phrase “everyone has a right to free healthcare” should be limited to “citizens only.”
The legal opinion presented is that this would not require a constitutional amendment but is instead a policy matter rather than a constitutional one.
My concern with that framing is that it doesn’t reflect how this plays out in practice. These “policy decisions” are frequently taken on review to court and NGOs often succeed in having them overturned or declared inconsistent with constitutional principles. So it’s difficult to treat this as a purely administrative policy issue when, in reality, it is regularly tested and reshaped through constitutional litigation.

@koko_matshela The issues regarding illegal migrants go far beyond just unemployment. There is the issue of security, the issue of density, the issue of environmental impact and the issues around cultural preservation and respect, overall, we sum it as the issue for resources.What must be done?
This incompetent government grants bail to foreigners who are illegal in the country and has no data to show how many foreigners who are granted bail but never reappear in court.
We will keep exposing their incompetence!!
