It is a fundamental principle of natural justice that a person should not be a judge in their own cause, and that a decision-maker should be impartial and unbiased. In this regard, the concept of recusal is well-established in law, whereby a judge or decision-maker may be required to step aside if there is a reasonable apprehension of bias or a conflict of interest.

In the instant case of the Chairman of the Independent National Electoral Commission (INEC), it appears that a significant proportion of the Nigerian electorate have expressed concerns regarding his ability to discharge his duties impartially and without bias. In light of these concerns, it is pertinent to question whether it is appropriate for the Chairman to continue to preside over the forthcoming elections.

The principle of nemo judex in causa sua (no one should be a judge in their own cause) is a cornerstone of administrative law, and it is incumbent upon the Chairman to consider whether his continued involvement in the electoral process would be consonant with the principles of fairness and impartiality. In the circumstances, it may be argued that the Chairman's insistence on presiding over the elections, notwithstanding the manifest lack of confidence in his ability to do so impartially, raises questions as to the legitimacy and integrity of the electoral process.
