- Kierowca Romana Giertycha, pseudonim Foka aka 5 piw, założył dwie spółki o kapitale zakładowym wynoszącym całe 5 tysięcy złotych.

- Spółka Prokom, której właścicielem był Ryszard Krauze, sprzedała firmom Foki przyszłe i niepewne wierzytelności za kwotę 51 mln zł.

- Dwa miesiące później Polnord notowany na GPW (kontrolowany przez Krauzego) odkupuje te wierzytelności za 58 mln zł.

- W ten prosty sposób doszło do wyprowadzenia milionowych środków ze spółki giełdowej.

- Spółki Foki zapłaciły następnie kancelarii Romana Giertycha ponad milion złotych.

- Co najważniejsze: Roman Giertych reprezentował wszystkie cztery zamieszane podmioty, a od Prokomu jego kancelaria otrzymała ok. 5 mln złotych brutto.
