@EWess92 I think the majority just got tired of Judge Murphy. His order is pretty extraordinary if you think about it. He is practically dictating to the executive how to conduct foreign policy.
@NicoletteGlazer it seems to be the Court got annoyed with Judge Murphy and the first circuit, this is third time they had to stay the order. and the order is/was pretty extraordinary.
@s4mp_JermarJS90@Omowale99949437 had nothing to with that. as Mike tells it, Kevin was trying to a father to him, but when he was just really an uncle.
@FoxNews No way, can you imagine if attorneys on either side were able to get rid of the Juror who didn't see case their way during deliberations? This is beyond frivolous it's an insult and an affront to the whole Jury system.
@Mic_VegasSphere@SenJackyRosen has nothing to do with Trump. the federal government doesn't have the power with regard to the upper basin states. The real issue is that the states keep failing to come to an agreement among themselves for years now.
@NixonandIke@EdWhelanEPPC that doesn't really make sense, because there would be five votes to deny the stay already, he wouldn't issue an administrative stay in such an instance.
I cannot imagine the conservative Judges are ok with standing rulings in this case. I have doubts about Justice Kagan also.
@shipwreckedcrew my uninformed guess is that although the government asked for summary reversal. Amicus argument that the 9th circuit and district could not be trusted to apply Mullin wasn't meritless. Brian E Murphy still has an admin stay in effect, and denied yet another motion to lift, so...
@DHSGenCounsel probably going to need a writ of mandamus for Brian E Murphy. He previously refused to follow a SCOTUS order. When Justice Kagan has to remind you the SCOTUS orders have to be follow. that should say it all.
@joshgerstein it's probably because even though government requested summary reversal, an amicus basically argued that the 9th and the district court couldn't be trusted, so the court should take the case and direct the outcome.
@ReichlinMelnick sigh, the whole point of the statement, is because the case is standing on the aesthetic injury of one person. the whole point that the "aesthetic" value of something will vary from person to person.
@AutarkistThe@EWess92 I don't know if I would call it blinking, the first circuit all but told her they would issue a writ of mandamus. and it was 2-1 to against issuing it now, and the other 2 did a wink wink nod nod, please fix or we will issue a writ.
@joshgerstein SCOTUS wrote an opinion; it then issues usually around a month later an order giving effect to that opinion. I guess this group is complaining that the lower court issued this new order without waiting for SCOTUS official order.
