One of the pillars of the so-called 'union', regularly vaunted by the British Government to support their voluntary partnership narrative, is the retention of Scots law under the Treaty of Union 1707. Yet here we see a Labour government claiming that the High Court of England and Wales has jurisdiction over Scotland, with the words "antiquarian" and "desuetude" applied dismissively to what it refers to as "18th Century legislation".

The Acts and Treaty of Union—held up by the British state as the very partnership agreement that makes Scotland England's 'voluntary partner'—are, time and again, shown to be held in complete contempt. This is hardly surprising, of course, since it is hard to muster honest respect for a document you never took the trouble to consummate, let alone implement its provisions.

One tactic of the constant delay is to ensure that those who brought this case will run short of money. This is an important case for Scots law, for popular resistance to creeping muscular unionism (the British government's own unofficial term for colonial enforcement), and for the cause of Scottish liberation. It should, if at all possible, be supported by whatever people can afford.

The last thing we want is a Section 30 order. Requesting a Section 30 order is an act of treachery. England-as-Britain has no legitimate role in the process by which the people of Scotland exercise our right of self-determination. A Section 30 referendum cannot lead to independence being restored. Westminster cannot transfer powers which supersede its own. The doctrine of parliamentary sovereignty prohibits it.

A Section 30 referendum leaves final disposal in the hands of the British state. The SNP will tell you that if the result is a Yes vote, independence will surely follow. That is a lie. What ensues from a Section 30 referendum is entirely for the British government to decide. They will do everything in their not inconsiderable power to ensure that Scotland's independence is not restored. They will offer 'negotiations' which England-as-Britain would enter into as an independent nation with all the advantages over Scotland that the Union provides. Scotland, meanwhile, would engage with these 'negotiations' as a subordinate 'partner' in the Union supported by British civil servants.

Whatever the outcome of these negotiations, it won't be independence. It will be called independence. The pathologically gullible among us would hail John Swinney as a hero. It might be a long time before they realise nothing very much has changed.

The Section 30 process is a trap. Swinney would walk us into that trap. A large part of the independence movement would follow him like the children following the Pied Piper of Holyrood.
