Nishad says, “Dr. Prem had purchased a Grand Vitara vehicle. After driving it for about 21,000 kilometres, a problem arose: the vehicle would shut down. An indicator on the dashboard would signal an engine problem. He took it to the company, but the issue wasn't resolved. The company claimed that the fuel used was of poor quality—specifically, that bad petrol had been put in—causing the warning light and the engine shutdowns. The company itself then replaced the fuel with a different batch, but the vehicle stalled again after just 60 kilometres… After examining all the evidence, the court concluded that there was a defect in the vehicle and a deficiency in service and trade practices. Consequently, the court ordered the company to provide a new vehicle or, failing that, to pay a sum of approximately ₹20 lakh…”
