Today, the petition seeking registration of an FIR against Ms. Karishma Aziz is listed before the Court of the learned Magistrate.

On the previous date of hearing, the learned Magistrate directed us to place on record the definition of "hate speech", if any, as laid down by the Hon'ble Supreme Court.

In compliance with the said direction, we are relying upon the judgment of the Hon'ble Supreme Court, which classifies hate speech into the following three categories:

1. Content-based hate speech;
2. Intent-based hate speech; and
3. Harm-based hate speech.

Each of the posts referred to in the petition satisfies the threshold laid down by the Hon'ble Supreme Court for constituting hate speech.

It is also pertinent to note that the earlier account from which Ms. Karishma Aziz had published these posts has already been deleted after we approached the Grievance Appellate Committee.

However, the legal consequences of the derogatory posts survive notwithstanding the deletion of the account.
