Lt. Colonel Robert Maclaren retired from the British Army in 2001 after a long fulfilling career. On the day that he retired he received a letter from the Personnel Department of the Ministry of Defence setting out details of his pension and, in particular, the tax-free ‘lump sum’ award, (based upon completed years of service), that he would receive in addition to his monthly pension.
The letter read:
“Dear Lt. Colonel Maclaren,
We write to confirm that you retired from the Royal Scots Dragoon Guards on 1st March 2001 at the rank of Lt Colonel, having been commissioned into the British Army at Edinburgh Castle as a 2nd Lieutenant on 1st February 1366.
Accordingly your lump sum payment, based on years served, has been calculated as £68,500. You will receive a cheque for this amount in due course.

Col Maclaren replied:
“Dear Paymaster,

A month passed by and then in early April, a stout manilla envelope from the Ministry of Defence in Edinburgh dropped through Col Maclaren’s letter box, it read:

2. The fact that you only reposted, reported or republished a defamatory statement makes you liable to the extent to which the original maker or author will be liable to the Claimant even if the original maker or author is not made a party to the suit.

I will tell you exactly what happened.
But I need you to understand the context first because without context it sounds like a small thing. And it was not a small thing. It just looked like one from the outside.
It was a Tuesday morning. Normal road. Normal checkpoint. I pulled over calmly because I had nothing to hide. Every document in that car was valid and current. Insurance. Hackney permit. Driver's license. Everything.
He collected them. Looked at them. And put them in his pocket.
Not on the bonnet. Not on his clipboard. In his pocket.
Then he told me to park to one side.
I asked what the issue was. He said "you know what the issue is."
I did not know what the issue was. Because there was no issue. That was the issue.
He held my documents for three hours on that road. Three hours. While I watched him wave car after car through. Some he stopped briefly. Most he collected from and waved on. The ones who settled moved. The ones who didn't moved eventually anyway after he made his calculation about who would fight and who wouldn't.
He calculated wrong with me.
But here is what finally pushed me all the way to Federal High Court and not just a complaint letter or a social media post.
It was not the three hours.
It was not the money he was looking for.
It was the absolute certainty on his face.

Apparently, the HAGF had discontinued a criminal matter against Mr A. Learned Silk, of Counsel to Mr A filed a motion urging the FHC to discountenance the Nolle.
