My dear brother, Tobi. We do have many problems and a constitution that is not fit-for-purpose is certainly one of them. Being that the Constitution is the foundational law, any structural weaknesses will lead to dysfunction and even impunity in many areas.

I will urge you not to fall for the public sector “incompetence” fallacy that many in the private sector spout so arrogantly. There is actually a lot of competence at the upper echelons of the public sector, which is where grand corruption happens.

The practice of grand corruption is very competent and sophisticated, often aided by private sector experts. It is often a joint criminal enterprise because it is virtually impossible for any one person to steal government money alone. Many cases that come to light only do so when the “sharing formula” is breached, not necessarily as a result of incompetence.

The notion that we would somehow get better Nigerians from outer space to come and run a better country is laughable. We must continually constrain the ability of people to get away with doing the wrong thing. The first step is having a proper legal system that draws from a constitution that is developed by consensus.

A new constitution will not solve all our problems. What the process of developing one would do is to afford us the opportunity of deciding the kind of country we want to have. After apartheid, South Africans came together to decide on the kind of country they wanted. They did not continue to amend the apartheid constitution and say the problem is the people.

We should have done the same when we returned to democratic rule. Obasanjo recognised the need and made a show of doing so but his heart was never in it. The 1999 Constitution largely mirrors the 1979 Constitution which he had authored as military dictator. It suited him down to the ground.

I agree that impunity is one of the major problems we have. It is not the only one. But additionally, we need to look at the structural problems that make that impunity possible. An example is a unitary policing system that was designed by colonialists to worship the “big man” and oppress the citizen. We have been ‘amending’ that particular institution since the colonialists left, without success. It is my considered opinion that it would never work in its current form.

We have a Land Use Act that confiscates one of the most important factors of production (Land) and makes it a patronage to be dispensed by governors. It is enshrined in our Constitution, so to change it you must change the constitution.

There are just some things that we need to press the reset button on. The Constitution is one of them.
