‼️ 𝗨𝗥𝗚𝗘𝗡𝗧𝗘 | 𝗟𝗮 𝗝𝘂𝘀𝘁𝗶𝗰𝗶𝗮 𝗹𝗲 𝗽𝗼𝗻𝗲 𝘂𝗻 𝗹𝗶́𝗺𝗶𝘁𝗲 𝗮𝗹 𝗗𝗲𝗰𝗿𝗲𝘁𝗼 𝟯𝟳𝟴/𝟮𝟬𝟮𝟱 𝗲𝗻 𝗱𝗲𝗳𝗲𝗻𝘀𝗮 𝗱𝗲 𝗹𝗮 𝘀𝗲𝗴𝘂𝗿𝗶𝗱𝗮𝗱 𝗮𝗲́𝗿𝗲𝗮

La Cámara Nacional de Apelaciones del Trabajo resolvió hacer lugar a la medida cautelar presentada por APLA y suspender los efectos del 𝗗𝗲𝗰𝗿𝗲𝘁𝗼 𝟯𝟳𝟴/𝟮𝟱 hasta tanto exista una sentencia definitiva sobre el fondo de la cuestión.

El fallo reconoce, de manera clara, que existen elementos suficientes para considerar que la modificación de los tiempos de servicio, vuelo y descanso de las tripulaciones podría generar un impacto sobre la fatiga operacional y, en consecuencia, sobre la seguridad aérea.

Además, la Cámara remarca un punto central planteado por nuestra organización: la ausencia de participación y consulta previa de todos los sectores involucrados, algo que el propio Estado había considerado indispensable en la normativa anterior por tratarse de una materia extremadamente sensible, vinculada directamente con la investigación médico-aeronáutica y la seguridad operacional.

La Justicia también recordó que el derecho al descanso, la jornada limitada y la protección de la integridad física de los trabajadores poseen tutela constitucional y supralegal, y que en materia aeronáutica no es necesario esperar a que el daño ocurra para actuar preventivamente.

Esta resolución representa un paso muy importante y ratifica la legitimidad del reclamo que venimos planteando desde un primer momento: la seguridad operacional no puede flexibilizarse en función de objetivos económicos o de eficiencia.

Los/las pilotos conocemos perfectamente la responsabilidad que implica cada operación.

Defender condiciones adecuadas de descanso no es defender privilegios. Es defender estándares profesionales, proteger a las tripulaciones, cuidar a los pasajeros y preservar la integridad de todo el sistema aeronáutico.
