Public workers can't strike in NY — except LIRR employees, thanks to their union's exploitation of a loophole from the Railway Labor Act of 1926.
But unlike in 1926, LIRR is no longer involved in interstate freight commerce -- it's purely an intrastate commuter railroad. It's labor relations should therefore be a matter of state rather than federal law.
Hochul should sue to reassert New York's 10th Amendment rights, allowing her to enforce the Taylor Law's ban a strikes by NY public employees.
She should make this the last time commuters get held hostage by a public sector union.
