Concerned by the new amendments to legislation on #SAR in #Italy. These are only the most recent changes, but they again seem designed to restrict the space for #HRDs to support people at risk in the #CentralMed. Another move away from solidarity by an #EU state @ItalyUN_Geneva

Yesterday, the Advocate General of the CJEU presented his opinion on our lawsuit against EU anti-smuggling laws. We hope the Court will have the courage to go further in its judgment, setting clear limits on the excessive criminalization of a wide range of actions. #Kinsa

Gestern hat der Generalanwalt des EuGH seine Stellungnahme zu unserer Klage gegen die EU-Anti-Schleusergesetze abgegeben. Wir hoffen, dass der Gerichtshof in seinem Urteil (Anfang 2025) weitergeht als diese und der Kriminalisierung jeglicher Handlungen klare Grenzen setzt. #Kinsa

THE OPINION OF THE ADVOCATE GENERAL IS OUT‼️
Yesterday, the Advocate General of the European Court of Justice delivered his opinion on the #Kinsa case, the lawsuit challenging the facilitation laws both at European and Italian level.

We remain firm in our belief that facilitating entry should not be criminalized and that people have the right to move freely.
At the very least, the EU should not criminalize acts motivated by solidarity and the intent to uphold the dignity and rights of individuals.

When it comes to criminal offence of aiding and abetting "illegal entry", courts should not equal commercial smugglers and humanitarian or private helpers. This is required by the principle of proportionality, according to the expert.
While many are talking about losing hope or moving to other countries, Native people have survived under U.S. government leaders that wanted us dead since the very beginning. This is still Native land, and will always be Native land. We never had the luxury to stop fighting.
What is actually happening here at the moment?
The court has to set a value in dispute.
How much money is involved.
It can request a new expert opinion or refer to the old one.
When sum X is announced, both parties can either agree or refuse.

We need a paradigm shift that goes beyond acknowledging that migration facilitation should not be criminalised and instead recognises that it is necessary to effectively guarantee the rights of people on the move.

The #KinsaCase represents a milestone in the battle of activists, organisations and migrant support groups against facilitation laws.
‼️ It’s the first case to successfully challenge these laws before a European court.

🗓 On the 7.11 the Advocate General will present his view on the case and, although it’s not binding, it is generally considered to have an influence on the court's position.
▶️ The CJEU will deliver its ruling by the end of this or the beginning of next year.
