⚖️COURT UPDATE⚖️DJ Akademiks and related defendants have asked a New Jersey court to dismiss Fauziya Abashe’s complaint without prejudice over alleged discovery failures — and to force her deposition to go forward on a court-set date. In a motion filed April 22, 2026, defense counsel for DJ Akademiks, along with several associated LLC defendants, says Abashe still has not produced key discovery that she previously said would be provided after entry of a protective order.

According to defense counsel Robert A. Ferraro’s certification, Abashe answered Form A interrogatories back in December 2024 and indicated she had responsive materials including police reports, medical records from Penn State Health St. Joseph, a SANE report, surveillance footage from Allen’s residence, and communications between Abashe and Allen. The motion says a protective order was entered on November 7, 2025, but those materials still have not been produced. Defense counsel says he followed up by letter on April 8, 2026 and by phone on April 22, 2026, without receiving the requested items.

The defense is also pressing the deposition issue. The filing says a notice to take Abashe’s deposition was served on March 31, 2026 for April 28, 2026, but on April 22 plaintiff’s counsel advised that she could not appear that day. Because the discovery end date is listed as May 28, 2026, defendants are now asking the court to set a firm deposition date of May 14, 2026 at 10:00 a.m., either virtually or at defense counsel’s office in Rutherford, New Jersey.

The proposed order goes further than just scheduling. It would dismiss Abashe’s complaint without prejudice for failure to comply with discovery and require her to appear for the May 14 deposition. It also warns that if she then fails to appear, the complaint would be subject to dismissal with prejudice.

The filing includes one important piece of context from Abashe’s earlier discovery responses. In those answers, she alleged that on July 16, 2022, she was invited to Livingston Allen’s New Jersey residence, where she says she was drugged and sexually assaulted by Allen and others, and that a SANE exam, police investigation, and surveillance footage supported evidence of non-consensual acts.
