Pres. Trump's announcement this morning that he's going to make changes to USDA regulations that require USDA meat inspections in a manner that precludes state and local meat processing and direct sale to consumers is exactly the kind of purpose-driven decision-making that is a huge reason for his political support.

This issue arose in an interview with Glenn Beck earlier this week when Beck -- who owns a cattle operation in Texas -- asked him to look at the market monopoly of Big 4 meat processing companies who have purchased dozens of smaller processors for the purpose of shutting them down, knowing that the barriers to entry into the market for new processing companies were such that their consolidation would allow them to dictate both what they paid ranchers, and what they charged for processed beef to distributors.

Almost every prior President would have paused while the political implications of this change -- via lobbying against it by the Big 4 processors -- had an opportunity to jump in and strangle it.

Trump dealt with it like a CEO of a family owned business -- he looked into like he said he would, didn't like what he was told, so he said "Change it."

That's why he's a "One of One" President.

I'll add that I would put an asterisk next to any of the GOP appointees in the other circuits that are Bush appointees -- they'd need to be considered one-by-one as you always have the J. Michael Luttig dynamic to consider when it comes to Bush era judges.

Part of the reason is they don't have local or state processing companies -- they have all been purchased and closed by the Big 4 and the barriers to entry are such that no new ones enter the market.

Ranches have to process their own -- and take on those expenses -- or they sell to the Big 4 at prices dictated to them.

I can buy from local ranchers -- Northern Nevada has several -- but its 50% or more higher than retail at Costco. So their customers are really only those who are not price-sensitive. Part of that cost are the inspection costs imposed by mandatory USDA requirements.

Being treated in the same manner as a legal immigration is not the same as being a legal immigrant.

TPS affords them the same treatment as legal status while it is in effect, but it does not give them legal status that extends beyond TPS's termination.

Charges and alleged conduct
Maka was charged in a third superseding indictment with recruiting, transporting, and harboring men from Tonga to work in his pig-farming, landscaping, tree-trimming, and masonry businesses. Prosecutors alleged that between about May 2001 and January 2003 he smuggled roughly seven Tongan men into the United States using other people’s passports, withheld their documents, housed them in squalid conditions at a Nanakuli pig farm, paid them little or nothing ($40–$200 a week, and sometimes nothing), required long hours, and used beatings and intimidation to keep them working. Witnesses described inadequate food (including claims that workers resorted to eating stray dogs) and violence with objects such as boards and other items. He faced counts of human trafficking, involuntary servitude, forced labor, unlawful conduct involving documents in furtherance of trafficking/servitude/forced labor, alien smuggling, and alien harboring (8 U.S.C. § 1324). Trial, verdict, and sentence
After a 12-day jury trial and five days of deliberations, the jury convicted Maka in December 2004 of six counts of human trafficking related to involuntary servitude and forced labor, three document-related counts, six counts of involuntary servitude, six counts of forced labor, seven counts of alien smuggling, and six counts of alien harboring. U.S. District Judge Susan Oki Mollway sentenced him on April 28, 2006, to a total of 26 years in prison. The court did not impose sentence on the six forced-labor counts because it viewed them as multiplicitous with other convictions. The judge noted community service Maka had provided but found it did not erase responsibility for the crimes the jury found, including beatings and a pattern of smuggling. Appeals and post-conviction proceedings
Maka appealed. In an unpublished 2007 decision, the Ninth Circuit affirmed in part, vacated in part, and remanded. It held that the human-trafficking counts were not multiplicitous of the involuntary-servitude or alien-smuggling/harboring counts under the Blockburger test (each required proof of a fact the others did not). It directed the district court to vacate the forced-labor convictions rather than merely decline to sentence on them, because those convictions still triggered special assessments that would amount to additional punishment. The prosecution was handled by the U.S. Attorney’s Office for the District of Hawaii (Assistant U.S. Attorney William Shipley among those involved). Maka had a prior, separate 1980s–1990 immigration-related administrative matter involving his landscaping business and unauthorized workers, which is distinct from the 2003 criminal trafficking case.
