4. H-1B visa holders do not apply for SSN through EBE, that EBE program is either for (1) work permit (EAD) applicants who request SSN on Form I-765 or (2) for immigrant visa/green card applicants when they apply at a US consulate or adjustment of status through Form I-485.
This is such a fascinating statement. Congress granted the executive branch the authority to designate TPS in INA Section 244(b)(1) and humanitarian parole in INA Section 212(d)(5)(A). He knows it's legal. Why not introduce legislation to change the law? He's a senator!
of course the answer is nothing matters and he just wants to whip up xenophobia. but there's an actual policy difference; they will actually revoke TPS designations (Trump did for Haiti!) but they can't defend their policy because it would entail *creating* illegal immigrants!
