P112.5-M PLUNDER CASE VS SARA
House Senior Deputy Speaker and Pampanga 3rd District Rep. Aurelio "Dong" Gonzales Jr. said that the House Committee on Good Government and Public Accountability may recommend a plunder case against Vice President Sara Duterte if she fails to account for P112.5 million in confidential funds that were encashed as cash advances by one of her close aides during her tenure as Secretary of the Department of Education (DepEd).
In a statement on Sunday, October 27, Gonzales pressed for clarity regarding the questionable disbursement uncovered during the committee's hearing on October 17, chaired by Manila 3rd District Rep. Joel Chua. The funds were withdrawn through three separate checks, each worth P37.5 million, issued to DepEd Special Disbursing Officer Edward Fajarda during the first three quarters of 2023.
Gonzales emphasized the need for accountability, asserting that the money belongs to the public and must be used properly. He warned that if the Vice President cannot provide a clear explanation of how the funds were utilized, the committee may pursue legal actions, including a plunder case, to protect public interest.
During the hearing, Gonzales questioned DepEd Undersecretary for Finance Annalyn Sevilla regarding the disbursement and Fajarda's role in encashing the funds. Sevilla confirmed the legitimacy of the checks and explained that her office's role was limited to processing the disbursement, not overseeing the usage of the funds.
However, she acknowledged the absence of records on how the funds were ultimately spent, raising concerns about transparency and potential misuse. Gonzales highlighted discrepancies in the documentation, questioning the labeling of the funds and their categorization as Maintenance and Other Operating Expenses (MOOE) rather than confidential funds.
Fajarda, who encashed the checks, was not present at the hearing but has been subpoenaed to testify in the next session. His testimony is anticipated to provide crucial insights into how the funds were managed after being withdrawn.
Gonzales expressed his concern over the logistics of handling such large sums of money, questioning how Fajarda could transport P37.5 million in cash on three separate occasions without significant oversight.
The confidential funds in question were part of a P150 million allocation to the DepEd in 2023 for programs addressing abuse prevention in schools, anti-extremism efforts, and counter-insurgency initiatives. This was the first inclusion of such funds in the DepEd budget, raising questions about the agency's handling of sensitive resources.
Gonzales warned that the committee might be compelled to recommend a plunder case, a non-bailable offense punishable by life imprisonment, if Duterte fails to provide a satisfactory accounting of the funds. With the plunder threshold set at P50 million, the questioned amount significantly exceeds that limit.
Although the Vice President is an impeachable official, legal experts have clarified that she does not enjoy immunity from suit, leaving her vulnerable to criminal charges while in office. The Chua panel will continue its investigation, with Fajarda's upcoming testimony expected to be crucial in determining the proper usage of the funds.
As of now, Duterte, who served as DepEd Secretary from July 2022 to July 2023, has yet to respond to the allegations.
