Client granted ILR in a 322(5) case this morning. A sweet end to a long ordeal. I represented him in his permission hearing (pre Balajigari) and drafted a response to the minded to refuse letter. @imperium @paulturnerlaw

UTJ Rintoul grants permission for judicial review in 322(5) tax discrepancy case where 2 MTRs and a questionnaire were issued and an interview was conducted. The UT also found arguable that the grant of limited leave was contrary to the wording of the Rules. I appeared at the OPH

After a previous successful Cart JR, the UT has remitted a 322(5) appeal to the FTT following an error of law hearing. The FT's determination was procedurally unfair. Apparently Cart JRs should be abolished though...... I was instructed under the direct access scheme throughout.

FTT allows 322(5) of one of the four appellants in the linked Balajigari case in the Court of Appeal. I represented the appellant under the direct access scheme. Closure after nearly 6 years!

322(5) appeal allowed on the spot. The judge said he was going to find that my client had engaged in deception but, after reading my ska and hearing my submissions, changed his mind. 5 years after it all started, with trips to the UT and Court of Appeal, it’s over! @paulturnerlaw

UT allows 322(5) direct access appeal. The HO said by email it was fighting the appeal. Today, after 90 mins of my submissions, the HO conceded in all 6 grounds and the UTJ allowed the appeal there and then. A total of 4 hearings but its over! @paulturnerlaw #immigration

322(5) appeal allowed! I was instructed by @_SyedNaqvi of @ITNSolicitors. The appellant had previously had his 322(5) appeal dismissed; he reapplied, was given a right of appeal and managed to substantially change the course of his case.
