Thankyou @medhashri@htTweets@sonalkalra from bottom of my heart for giving such an elaborate coverage to cries of innocent men who are victims of legal terrorism. This shall give strength to countless men who are yet to speak up.
@bikas_cute@deeptanshukla
In a special today, we have attempted to throw light on the increasing & worrying trend of false domestic cases against men. Don’t miss this feature by @medhashri in today’s @htcity
DOWRY VS ALIMONY
Dowry started with very clean & noble intention of family of a woman giving her what's her due from family wealth at the time of marriage. It was to give her comfort of having her own things in a new home
It degenerated when men started thinking of it as a right & started torturing women for it. It eventually led to women dying by suicide, killing of women because of greed for Dowry
Concept of Alimony is also noble. It is for women who are not financially independent, are abandoned, have to raise kids without any support from husband. It was brought to prevent destitution & financial hardships after divorce. Had a lot of meaning when it was almost impossible for women to marry after divorce.
But it has degenerated today when just too many women think of it as a right despite being financially capable, educated, independent, having all the privileges. They've started torturing men for it filing false cases, stretching litigation for years, not shying away from stooping to any low dragging all family members, senior citizen parents to courts, filing false rape, POCSO cases as well just to achieve a huge settlement.
I am not exaggerating. Go to any police station or mediation centre & see across the country. There's bidding going on even inside the courts whether a man can afford it or not even for extremely short lived marriages. Women are being given Alimony even if they're the ones who were abusive & extremely cruel to the husband
Evil of dowry has been condemned, laws enacted, people punished. But false cases are only increasing to extract huge alimonies. Rather than punishing, system has become a part of it to squeeze the man. And hence there are cases of suicide by men, husbands being tortured & pushed to the brink. Some are being killed too.
If women shouldn't be seen as cash cow in Marriage by Men, Men should also not be seen as cash cow by women in situation of divorce if she's empowered & earning.
Greed from either sides is wrong & it becomes uncontrollable if not spoken against.
Putting entire financial burden of a failed marriage on the man is as wrong as putting entire financial burden on a woman to formalise a marriage
I wish people understood that

On 16th Dec 2024 at 10 AM (Monday), The revision case filed by #NikitaSinghania ; wife of #AtulSubhash for "enhancing" maintenance will come up in Court No-85 as maintenance granted to her is not sufficient.
Greed that was reason for #AtulSubhashSuicide#JusticeIsDue
DESPERATE PLEA TO @narendramodi@AmitShah@MLJ_GoI@arjunrammeghwal CHIEF JUSTICE OF INDIA
KINDLY ESTABLISH A COMMITTEE TO LOOK INTO MISUSE OF LAWS MADE FOR WOMEN & SUGGEST REMEDIAL MEASURES TO ADDRESS THE SAME
KINDLY INVITE FAMILIES OF MEN WHO HAVE DIED BY SUICIDE DUE TO GENDER BIASED PROVISIONS & LOOK INTO BRINGING GENDER NEUTRAL LAWS
Please give #JusticeToAtulSubhash
HE HAS SACRIFICED HIS LIFE SO THAT THE SYSTEM CHANGES AND VALUES LIVES OF MEN TOO!
There is a dire need for #MensCommission
I've read some most disgusting comments regarding the suicide of Sh. #AtulSubhash wherein people are condemning him as weak, mean etc.
To all those anti himan beings, pls listen. It's very easy to criticize someone but very difficult to contribute around you so that such a case doesn't take place.
• We need to work and spend more energy on #MentalHealth, learning of #LifeSkills and integration of #Spirituality in our day to day to lives from initial years of the life.
• The institution of family needs to be strengthened further.
• More focus on real people to people interaction rather than social media interactions.
• Lastly, we need to stop judging people when they approach us with their problems while still alive.

The Supreme Court has warned against the misuse of the law in marital dispute cases lodged by women against their husbands and families, saying that it cannot be used as a "tool to unleash personal vendetta".
A bench of Justices BV Nagarathna and N Kotiswar Singh on Tuesday made the observation while setting aside a cruelty case filed against a man and his family under Section 498(A), which the Telangana High Court had refused to dismiss earlier.
The woman lodged the case after her husband filed a petition seeking the dissolution of their marriage.
During the hearing, the Supreme Court said just a mere reference to the names of family members in such cases without providing evidence of their alleged involvement, cannot form the basis for criminal prosecution.

Big!
The Supreme Court has sounded a note of caution against growing tendency to misuse provisions like Section 498A of the IPC as a tool for unleashing personal vendetta against the husband and his family by a wife.
Really hope #AtulSubhash case becomes a turning point in this opaque area
Wake up GOI and reframe the laws..if men and women are equal in the eyes of law they must be treated equally and not women bashing men in the name of feminism and faulty laws! #JusticeForAtulSubhash#MenToo#AtulSubhash
The whole of today was spent in studying the #AtulSubhash case and presenting it in the most fair and balanced way possible. Spoke with everyone possible for this story, even reached out to Nikita Singhania his wife who ignored calls and messages.
It was the biggest trending story in India.
But even after today, never forget that there are a hundred other Atuls out there. Harassed by the system, betrayed by women, misjudged by the society.
Make no mistake. This is not a one off
🚨DO READ HOW THE MAINTENANCE LAW IS MADE IN FAVOR OF WOMEN AND AGAINST MEN: In India, maintenance laws regarding wives are governed under various statutes such as the Hindu Marriage Act, of 1955, the Nagarik Suraksha Sanhita, and the Protection of Women from Domestic Violence Act, of 2005. The concept of maintenance ensures financial support for the wife, especially if she is unable to maintain herself. Here’s an overview:
1. Under the Hindu Marriage Act, 1955
Section 24: Either spouse (husband or wife) can claim pendente lite (interim) maintenance and litigation expenses during the pendency of legal proceedings.
Section 25: The court may grant permanent alimony and maintenance to the wife, considering the financial condition of both parties, the husband’s income, and the wife’s needs.
2. Under the Criminal Procedure Code, 1973 (Section 125)
A wife (legally wedded) can claim maintenance if she is unable to maintain herself.
•Conditions:
The husband has sufficient means but neglects or refuses to maintain her.
Even a divorced wife is entitled to maintenance if she remains unmarried and cannot maintain herself.
Limitations:
•A wife living in adultery or who has voluntarily abandoned her husband without reasonable cause is not entitled to maintenance.
3. Under the Protection of Women from Domestic Violence Act, 2005:-
The act allows a wife or a live-in partner to claim maintenance as part of the right to “monetary relief” under Section 20.
It covers cases of domestic abuse, ensuring financial support to maintain her standard of living.
Key Points
Maintenance is decided based on factors like the husband’s income, the standard of living during the marriage, the wife’s income (if any), and dependents.
Maintenance is not automatic; the wife needs to file a claim in court and provide evidence of her financial dependency.
The husband can contest the claim, providing proof of her income or misconduct (like adultery).
Supreme Court Guidance
The Supreme Court has emphasized that maintenance must ensure the wife lives with dignity and in a similar manner to how she lived during the marriage.
Courts have also ruled for time-bound disposal of maintenance applications to avoid unnecessary delays. #JusticeForAtulSubhash
