@montezumachavez No: the matter is covered by the GDPR. And, the view on health data is too narrow. And (!) it remains to be seen whether the publication of the athletes names is indeed in line with the latest CJEU case-law on public registers.
Persoonsgegevens verkregen in een strafrechtelijk onderzoek (naar ernstige misdrijven) mogen niet zomaar worden gebruikt in een tuchtprocedure tegen een ambtenaar. Arrest #EU-Hof, Letse zaak C-162/22 Lietuvos. #privacy@JBAGerritsen
@montezumachavez @DouweKorff I come to this conclusion after writing the Data Solidarity report from 2020 about AI-powered health research where this scenario was discussed. https://t.co/BCdvEIfBON
@montezumachavez I agree with @DouweKorff. If the 'research' is solely done for product development, then that's not the kind of (scientific!) research covered by Art. 89 #GDPR. However, there may be grey areas (e.g. product devs teaming-up with university staff, where output is shared publicly).

@FusterGloria@mario_gug I just hope they will include the notion of "biometric-based data" as it will solve some problems. GDPR's definition of "biometric data" is too limited and old-fashioned.

@FusterGloria@mario_gug pointed me in the right direction, but I still think the recital does not really sync with the Article containing the prohibition: https://t.co/x8TFer45NO

@RadekRadwan@YannickMeneceur Interesting indeed. The Netherlands had cases like that +10 (?) years ago, highlighting the need for the protection of 'archival integrity'.
⚡️Important human rights case, spotted by @YannickMeneceur.
